No

BUT if you are unsure and you CAN afford the attorney then that is not a bad way to proceed at all.

I'd have to disagree. There is a ban incurred for his wife's overstay. If ever there's a need for an attorney, this is it. He may not have the right attorney for the job, but I'd say he needs an attorney for the overstay ban.

well yes karee but he can still mail out the info and wait. If he encounter problems then he can get his attorney involved.

That changes things. He's more than likely charging you extra to have to deal with the waiver. Still seems expensive if you asked me, but your case is not a normal one.

he already charged me extra for the waiver, but now he is saying that he needs more money for consular processing in addition to what has already been charged. Doe this make sense? Another 2500 to help with consular processing........

It's not a matter of if. She will be denied at the embassy interview and given instructions on how to apply for the waiver. That is when the attorney should get involved IMO. THere's a whole section on waivers on this site. I suggest the OP go read up there.

I really don't know much about the waiver process except that she'll be denied at ther interview and then given instructions on what do do next. I would suggest doing some reading in the forum link that I sent you in my previous post.

I told him he can proceed or use his lawyer is he affords one. if thats bad advise plz give him better.

You said his attorney has already applied for the waiver. How is that possible when his wife hasn't even been to the interview? I'll be honest. I reported you to the Mods over this thread. there are alot of factors affecting overstay. It could be 3yrs ban instead of 10yrs. His lawyer obviously knows more about the case than you or me. I don't think his lawyer will make it optional for him to proceed by himself if he cannot succeed at all.

Report whatever you wish.

If i recall correctly you are the one bad talking all lawyers and advise him against using one.

people i need help here and that is why I am part of visa journey, lets not squabble here. I do just want the truth though, and if you do not know what you are talking about please refrain form responding. Pretty nervous over, and really sick of coming back and forth to peru. Want my family together in that states just as much as all of us.........so please speak nothing but the truth here.
