That is not true. It becomes more costly, but it will not automatically be denied. In fact, chances of denial are pretty slim if this guide is followed: http://www.visajourney.com/content/i130guide2

What I meant was, if they get married after the 90 days and file AOS under the K-1 visa, it will be denied. They need to start another process, so it's not automatically denied.

Don't ever do anything you're not willing to explain the paramedics.

file concurrent i130 i485. you cannot just aos now. pony up the cash since it was your mistake. overstays are forgiven for usc spouses. do not leave the country without ap, and preferably just wait in here till u get ur gc.

2006 - Entered US on F-1
2009 - COS to H-1
2011 - Married USC

Conditional GC Process:
04/2012 - Concurrent I-130 petition / I-485 AOS / I-765 EAD / I-131 AP sent
35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

29 days to biometrics, 105 days to interview, 147 days to oath and US citizenship

~ 9 years and 6 months from first entry to US citizenship

Rules are made to be broken! :dance: .... Unless of course you paid over a thousand dollars, waited about a year, and have been extremely excited about marrying the one you have been petitioning with... Then I just don't understand... :wow:

A-men to this!!!!! wow.gif is right! Why the hell would you apply for a FIANCE visa if you are not sure you are ready to be married? And the other post about, "Well, what if I stay longer and we still don't get married?" OMG!!! Are you for real? I have no words... Some people must think playing cross-global house/make-believe is fun... wow.gif

You know guys, it's very possible OP got here and found out something about the fiance that made them question whether or not they want to be married. It's VERY different living with someone than doing a long-distance relationship.

Let's give the benefit of the doubt until we know WHY they went past the 90 days eh?

You know guys, it's very possible OP got here and found out something about the fiance that made them question whether or not they want to be married. It's VERY different living with someone than doing a long-distance relationship.

Let's give the benefit of the doubt until we know WHY they went past the 90 days eh?

He wrote another post. It's because their lawyer took too long to do the pre-nup.

You should state why you didn't marry in 90 days because right now everyone is assuming it is because you two just didn't follow the rules. But could it have been due to illness or hospitalization or something like that? If so then maybe just maybe you can have the 90 days extended but if its bc you guys just didn't get married within 90 days then you have to redo everything but now with a marriage visa. And the international spouse most likely will have to go back to their home country to wait the approval of the new visa. When the tell you to get married within 90 days then you MUST get married within 90 days unless there was some type of complication which meant you physically could not get married.

Unless you're in a coma you can get married in a hospital. They can even wheel you in compelte with drips into a meditation room that most hospitals have.

One VJer got married on the international bridge between USA and Mexico to her spouse.
