Hi Vjers,

i am in F1 student status and i have an approved i130 for f2a category pd august 2010.I will graduate in august 2012 and have applied for F1 OPT EAD.

Will the approved I130 negate the approval of the F1 OPT application.Has anyone got F1 OPT approved with an already approved i130.????

An approved I-130 is not a reason to deny the F1 OPT. The I-130 doesn't matter at this point. For the rest of this post, ignore the fact that there is an approved I-130 for you.

To obtain an F1 OPT, you need to meet the requirement that you intend to return to your home country after you finish. Like anyone else seeking an F1 OPT, this is the requirement you must meet. Is there a home for you to return to????? If there is not, then you don't meet the requirement to have a home outside the US to return to after finishing your F1 OPT.
