has anyone experienced where you already obtained a child;s social security and american passport and your spouse is still waiing to be interviewed for their visa? the child is both the petitioner and beneficiary's child after succesful CRBA, would this make Interview alot easier. has there ever been visa denials, altough both parents have succesfully obtained the child's social security card and american passport

The child being a US citizen and having a passport does in no way guarantee the mother a visa. For the mother to get a visa, you need to prove the bonafide's of the marriage and- sorry to be crude- a baby proves you had sex one night, not that you are a true couple. There have definitely been visa denials even when there was a USC child between the couple. On the other hand, they will not issue the mom's visa without the child's CRBA being done (it was the only thing they were interested in when I had my interview). So having it will not help, but NOT having it will hinder.

All you've done so far is proven that the petitioner and beneficiary had sex, and that they produced a child. Having a child together helps at some consulates, and can also help with adjustment of status and removal of conditions. The anecdotal evidence is that it won't make an iota of difference with the CR1 visa at the consulate in Saigon. It's a widespread misconception in Vietnam that having a child will clinch the visa. I'm certain your wife has heard this from people she knows. My wife heard it from at least 20 people, some of whom claimed to be "experts" for US visas. Funny how the self-proclaimed "experts" are always the ones who themselves failed to get a visa.

The consulate knows that this misconception is common in Vietnam, and they know that many couples will produce a child solely for this reason. You'll still need the same relationship evidence that anyone else would need to get the visa.

Our daughter had a CRBA. They didn't even look at the pile of evidence we provided. They already had pink waiting. My wife was asked four simple questions. However, her visa wasn't issued until we straighten out a few problems with my Affidavit of Support. I don't think her interview would be that easy without the CRBA.

I don't agree that it doesn't help. It's not your ticket home, but it's definitely a plus to have.

It's a popular misconception in Viet Nam that having a US citizen child makes it easier for the mother to get an immigration visa. Lots of Vietnamese who have never even been inside the US consulate will attest that it is true without any real knowledge.

The US government realizes that love is not required to make a baby; only a few minutes of sex.

Yes, but in order for those few minuted to happen, there has to be some type of relationship. Not too many women will go to that length just to come to the U.S.

The government's position is that a couple with child tends to stay together longer than couple without.

Not at the consulate in Saigon. There have been several VJ members whose wives and children were left waiting in Vietnam for years while they were repeatedly denied visas because the consulate thought the relationship was a sham.

It's relatively easy to get pregnant, and something that any girl who wants to come to the US would be more than willing to do. They're going to have sex with the US citizen petitioner anyway. They're not going to marry this guy in Vietnam and then not have sex with him, and still expect him to petition for a visa. Likewise, they're not going to get engaged with him, get a K1 visa, come to the US, marry him, and then not have sex with him, and still expect him to sign an affidavit of support so they can get a green card. Bottom line is if there's no sex then the guy knows it's not real, and if the guy knows it's not real then there won't be a green card.

The fact that she had sex and got pregnant doesn't prove any sort of relationship ever existed. There have been plenty of stories here on VJ of Vietnamese brides who got their two year green cards and immediately ditched the US citizen petitioner, taking their kid with them.

The consular officers in Vietnam are well aware of what is perceived by most Vietnamese as factors that will help secure a visa. Everyone knows that a Dam Hoi is virtually required for a fiancee visa. Scammers will try to get away with the bare minimum - a small informal ceremony in the beneficiary's home, followed by a small casual party at a local restaurant with a dozen or so family members. The CO's are on to this charade. They want to see a very formal ceremony, complete with Ao Dai and a procession of family members bearing gifts in red boxes. They want to see a very big party with the petitioner and beneficiary in formal attire, and hundreds of guests. In other words, they insist on seeing the real deal and not some hastily arranged mock up.

The consular officers in Vietnam are also well aware that there is a very common perception among Vietnamese that having a baby will clinch a visa. The fact that you believe it's true is proof of this. They also know that some people will intentionally get pregnant because they believe it will improve their chances of getting the visa. For this reason, they give very little credence to the fact that the beneficiary is pregnant or had a baby. They still want to see the same sort of positive evidence, and the lack of any negative evidence, that they would want in any other case.

I've seen visas approved in Vietnam where there was a baby involved. I've also seen visas approved in Vietnam where there was no baby involved. The only difference the baby made was that it delayed the issuance of the visa. The consulate won't issue a spousal or fiancee visa until the CRBA issue has been resolved.

Looks like you're married to a Vietnamese woman, yet you think so little of them.

I never said having a baby will clinch a visa. I said having a CRBA is a plus......

Vietnamese are not any more virtuous than anyone else.

I know of plenty of Vietnamese familes willing tomarry off a daughter to any Viet Kieu. Even a Viet Kieu who is a scumbag.

When I was traveling through Vietnam, I had three different families approached me about marrying their daughters.

Once when I was walking through the local market with my aunt who lives in Vietnam, a woman approach my aunt and asked if I was from America. Without knowing my name or anything about me, she offered to let her 18 years old daughter marry me.

I know of another family who married off a daughter to a Viet Kieu who was already married. Knowing that he could never petition for her while he was already married, all they wanted was money to be sent to Vietnam

So just because someone is critical of some Vitnamese who will do anything to come to America, it doesn't mean he does not have respect for all Vietnamese women.

Some Vietnamese have no problem whoring out their daughters. Some Vietnamese have no problem marrying and having kids to get a green card.

Stop with the holier than thou attitude. Some Vietnamese families will do anything to get a green card. Not all Vietnamese are virtuous.

Really, what does that say about woman you married? I guess they're the exception? I lived in Vietnam for two years, I've never had anyone offer their daughters off the way you mentioned.

I never said all Vietnamese are virtuous. I said not many women would risk having a baby just to go to the U.S.

Anyway, we're getting off base, this discussion is about whether or not a CRBA would benefit....

my wife has her CR1 interview next Tuesday august 7th, hopefully all goes well. she is really nervous, and it is normal to be nervous. i know having a CRBA doe not prove a bonafide relationship but hopefully it does help. I have been to dananag 4 times in the past 2 years to see her.

i know some people are willing to sell off the daughters for money or do anything to get to america. my dad use to live in danang for years when he was younger so he knew her family and we were introduced over the phone my my dad and her mom in january 2010. we did the whole vietnamese wedding and the procession where people came to her house and she wore the traditional vietnamese dress. we had a wedding a ceremony at a resturant with 200 guests insluding my parents who flew to danang with me. i was in my suit and she was in traditional white wedding gown. we did not get a marriage license until months later from the service of justice, i did not know if they wanted to extort money or what but they eventually called my wife months later and said we can now get the marriage license months after the wedding ceremony. i came back to danang and we got it, still a difficult process second time around. we kept pestering them. since my wife was 8 months pregnnt the service of justice use that timeline to determine if it wa actually my child considering last time i was in danang was 8 months prior. we got it.

following year visited her and saw my son for the first time in januaury 2011, in april came back, had a birthday party for my son who turned a year old. i took my wife and son to HCMC and submitted a CRBA, the interview was simpler than i thought, we had an american lady interviewing us, i had all my paperwork completed. i was a nervous, and she understood how difficult the service of justice can be. of course i think the interviewer also use her own discretion to determine if the kid and I looked similiar.

i am blessed and fortunate with her, the family is not rich, they are poor, they never pester me for money. ive heard from other people in the states when they go back they kept getting pestered for money by family. when i go they do take care of me, i take them out to dinner or lunch and introduce to them american diet in danang. BREAD of LIFE is fantastic for american food in Danang. I do hang out with her friends and we eat snails.

i know the IV interview is tougher and not as easy than getting the CRBA. i have ready from other VJ members their IV were simple while other interviews were difficult, it seems you are at the mercy of the CO, hoping they are in a good mood. in my wife's and my eyes we do have a real relationship, proving that to the CO can be difficult after reading some threads of visa denials on VJ.

i still thank you for everyone for their honest opinions and comments. I pray the IV will go well and i can bring them to states with me
