Hello everyone,

Has anyone here been married in Dubai to a non-UAE citizen and filed the immigration paperwork there? I'm American and he's Yemeni but a resident of Dubai... We met in America and I'm supposed to fly to Dubai for 2 weeks in Oct to marry him and file the application for his greencard while I'm there. I'm trying to find out what all we both need to have with us in order to get married in Dubai and to file for the K3 while I'm there. Thanks

You should be filing a CR-1. Not a K3. You can read the guides at the top of this page for more info.

HUSBAND'S CASE

9/17/2011 - sent I-13

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

KIDS' CASES

04/20/2012: NOA107/20/2012: instead of an approval, we got thrown into AP. sigh

11/01/2012: Boys' I-130 interview set for November 28, 2012.

11/28/2012: I-130s APPROVED! APPROVED! APPROVED!

NVC

12/14/2012: NVC Received

12/31/2012: Case number/IIN

12/31/2012: DS-3032 sent

01/08/2013: DS-3032 accepted

01/02/2013: AOS bill0

1/03/2013: AOS bill shows PAID

01/04/2013: AOS package sent

01/09/2013: IV bill

01/10/2013: IV bill shows PAID

01/11/2013: IV package sent

01/23/2013: Case complete

02/01/2013: Interview scheduled

US Embassy Lagos

02/22/2013: Embassy received

03/01/2013: Medical

03/20/2013: Interview - was told the boys would have been approved on the spot if they had pics! Errrr :-(

04/15/2013: DNA test

05/15/2013: Emailed embassy BEGGING them to let boys drop off passports for visa insertion. IT WORKED!!!

05/31/2013: Visa in hand

06/02/2013: POE JFK!!!!!!

get married there, file the 1-130 cr-1 you dont use the k-3 any more it's discontinued, no longer used,as of two years ago.you will still see it in the guides just disreguard it,the cr-1 is used in its place.

OK thanks, it seems that the application for CR-1 is still an I-130 so what I need to know please is if there are any problems with foreigners getting married in Dubai and filing the application at the embassy there (I guess it's in Abu Dhabi) during the 2 weeks I'm there. What kind of proof would we submit for a legitimate marriage since we'll only be living together for 2 weeks while I'm there AND most importantly will they even marry us since I'm not an Emirate resident but my fiance is?

I don't think the Emirati's will have an issue concerning your marriage to him on their soil but it would be better if you let him ask beforehand just to be sure. When you're together take lots of pictures with each other preferably at different locations (on different days) because you will be asked about them later on.

I don't think the Emirati's will have an issue concerning your marriage to him on their soil but it would be better if you let him ask beforehand just to be sure. When you're together take lots of pictures with each other preferably at different locations (on different days) because you will be asked about them later on.

My husband and I had a similar situation.........I am the USC, my husband is Egyptian but was working in Qatar and had a Qatar residence visa. I went to Qatar and we got married at his Egyptian embassy, then when I came back to the states, I filed our I-130 and our marriage certificate was fine for USCIS (from the Egyptian embassy in Qatar).

There should be a Yemeni embassy in Dubai and you could get married there and get your marriage certificate from them.

Your husband will need to find out what the requirements are.. I remember there used to be a requirement for a letter from the bride's father granting permission for the marriage. My info is about 10+ years old and maybe outdated.

For the OP, it's better and easier for them to get married at his Yemeni embassy if possible.

I also lived and worked in Dubai......my husband and I were going to get married in Dubai also.....the letter your talking about is if a couple gets married in the local Dubai courts, not at their country's embassy (Yemen, for example). For the OP, it's better and easier for them to get married at his Yemeni embassy if possible.

Yes that is correct. I-130 and I-485 petitions are submitted to USCIS in the US. These measures have been in place for a while now so you really ought to read up on the IR-1/CR-1 guide here on Visa Journey and the USCIS website.

He doesn't apply at the embassy, BTW. Your I-130 petition, if approved, will be sent to the US Embassy (or whichever consulate does such immigrant visas) in the UAE and he'll need to interview there. Then if he passes the interview/consular stage he'll get his 2 year conditional green card.

That sucks... as I recall the process used to be much faster when applying directly at the embassy/consulate in the other country. I guess I have a 2 year wait to look forward to :(

Not exactly 2 years. Could be less, could be more. It all depends on whether or not you do the paperwork correctly the first time around with the I-130 package (RFE's slow the process down significantly) and how long the Administrative Processing/Review takes at the Embassy. This is what we get for choosing to be with Arabs. Especially Yemenis :wacko:

At least you can more safely visit your husband in the UAE. Yemen is not exactly a cake walk these days.

He has never even lived in Yemen... He was born and raised in Saudi and been living in Dubai for the last 10 years. Anyway, I've done this before but through a different country/embassy and I remember it taking forever for a fiance visa... I was so hoping to file over there and him be here in a matter of months but oh well... thanks for letting me know ahead of time so I at least know what I'm looking forward to
