Timeline

Hello VJ!

I received my hard copy of the NOA1 in the mail a day ago and noticed the birthday of my spouse (beneficiary) was not correct.

After all my reviewing, it appears I made a mistake on the I-130. :(

I entered my spouse's birthday wrong (for some reason I wrote it a day off...).

Clearly I need to call USCIS about this.

What should I expect to see happen?

Will have to to send another copy of the I-130? (Just the I-130 or more?)

Will this change the RECEIPT NUMBER they have given me?

Please assist.

i say don't fret for now.

It's difficult to not be upset (and a bit panicked) right now!

I'm not sure I understand "correct it with the DS-230 intake later at NVC".

Shouldn't the I-130 be 100% correct to prevent any issues?

Or is it OK to forget about the mistake and continue waiting for the later stages without contacting USCIS about the problem?

The I-130 is just to establish a relationship which would make them eligible for the next phase of immigration. Is it messed up on the G-325? If so that could be a problem. The DS-230 is the most important and you need to make sure that all the information is exactly as it should be. I'm sure during the review process you will get a RFE at that point you will submit biometric page of passport, birth certificate, etc to show actual date of birth and that the ds-230 is corrent.

The G-325's are both correct.

I suppose I will wait and not take any actions. Hopefully this will pass without trouble as I'm a bit upset with my mistake and really don't want to be forced into waiting longer.

I really wouldn't worry too much about it yet, you will still need to send in the DS-230 and passport copies, so it will get fixed at some point. They also misspelled my second name all through NVC (a typo on their part), and when I emailed them about it they said it'll get fixed once I submit my birth certificate and passport photocopies - at the consulate at the latest. If you were to get an RFE for it, it shouldn't be too hard to correct, and would probably not delay your petition very much.

Honestly, I've heard of plenty of people making this kind of mistake (and even bigger ones, like dates and status of entry, and other wild things). As long as you correct it before the interview begins, there's no danger or harm. Obviously it's ideal to get all the info written correctly the first time, but if not, immigration fortunately is understanding of the need to fix information. Don't bother calling USCIS. The phone staff people have really nothing to do with petition adjudication, aren't even in the same location as your petition, and are more likely to mix things up and create more chaos than anything else if they take any action at all. You also don't want your petition being somehow pulled out of line to try to correct this if you can actually get through to someone, as this is one way they get lost and/or the wait time gets lengthened. If they consider the birthdate issue a problem, they will RFE, but honestly, that's less complication-prone than trying to pre-empt an RFE. When an RFE is issued, the petition is already on an adjudicator's desk, and is simply placed aside waiting for the requested evidence, and then resumes its rightful place as soon as the evidence arrives. The best you can do is have evidence ready, such as an amended I-130, and copies of birth cert/passport, so that if you receive an RFE, you can submit anything requested right away.

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

Like others have said, it shouldn't be a big deal, as long as it is corrected at the NVC stage.

I had made a similar mistake by providing an incorrect address for my spouse on the I-130. I called USCIS and was instructed to send in a letter explaining the change, along with some proof. I did just that, and included my spouse's ID with the correct address. I did not experience any problems.

11/04/11 Got Married

USCIS:

12/28/11 - I-130 Sent

12/30/11 - NOA1 Received

06/08/12 - NOA2 Received

NVC:

07/02/12 - Case arrived at NVC

07/12/12 - Received case #, IIN, and BIN, gave e-mail addresses

07/13/12 - E-mailed DS-3032 from Beneficiary's e-mail address

07/23/12 - AOS bill invoiced & PAID

07/24/12 - DS-3032 accepted, IV bill invoiced & PAID

07/25/12 - AOS bill appears as PAID, IV bill appears as PAID, AOS Package sent, IV Package sent

07/26/12 - AOS and IV Packages delivered to NVC

08/01/12 - AOS/I-864 accepted, Checklist Issued for DS-230

Hey there,

Don't worry too much about it. I sent in an I-130 with a similar mistake. I called them and just told them to note the mistake. The person on the other end of the phone is human. Unless you have some crazy mistake that totally doesn't make sense, it shouldn't be a problem and they will understand.

You have a lot of time on your hands and I suggest you prepare for NVC. Things will go fast when you hit that stage. Start on the packets for NVC and make multiple copies of it. If you don't already have the documents from Cambodia, have it sent here. ( I sent a copy of her birth cert and they didn't accept it) (wasted a month) It doesn't hurt to check and check and check again.

Keep communicating. That's probably the most important thing to do. That and football season kept me sane through out the process. Also, when you do a video chat, do a screen capture and make sure you have it set so it shows date and time and names. I used yahoo chat and printed those out with the pictures I submitted. I didn't care how personal the chat logs showed because I honestly don't think the CO cared too much after the interview about my private life and I most likely would never see that CO again.

The petition will be approved. An approved petition ALLOWS a foreign spouse to apply for an immigrant visa.

Have disparity of info, wrong info on the I-130? it's ok , as you'll correct it with the DS-230 ...
