The lawyer is right about divorce via notice in lieu of showing up, sometimes called abscentia.

However, the county clerk knows a lot, as well, so when you get some free time during the day, head out to the county clerk, talk a bit, ask where the templates are stored (usually it's at the county law library) and then make a new friend with the county law librarian.

Ok, I have finally gotten my estranged wife to respond to me very briefly, via e-mail only. After pressuring me for months and months to get her a Spouse Visa so that she can return her, she has abruptly decided that she is finished with me. So now there is only the issue of divorce in absentia.

Since she left a year and 1/2 ago, it more than qualifies for "desertion/abandonment" under the divorce laws in the state in which I live.

Yeah, I am just completely done with it..She left in the summer of 2012, and has now decided never to return. my only concern is somehow being required to pay her a settlement She brought nothing into the marriage, contributed nothing, and now has her own car and condo in her home country, which shows that she never had intent to return.

She also has no visa, and zero legal status here. Do you know of a web site that would discuss the issue of settlement or any liability?

I feel that her intents were completely fraudulent from day one..

I say study the templates at your county courthouse law library,

going over

--no-fault divorce and

--abandonment and

--property dissolution

for your state.

It very well may be that the court will award nothing to her in the divorce settlement, based on the wording that you put in on the divorce petition.

I heard back from my lawyer..He is not very conversant with the complexities of international divorce. He feels that if she will agree to an uncontested divorce that there will be no problem but that it could get very complicated if she contests. I still need input from someone who has gone through this problem to see whether we really have any liability to support a foreign spouse who has essentially deserted the marriage and our country..

I'm still trying to get more info..

you would have to handle the support issues

as if

she was living in the USA, a USCitizen.

What are the support issues for your state?

I'm betting none, since abandonment is the primary cause for divorce.

I don't know what claim she could have for support or assets from me; she left the U.S. voluntarily and has decided to never return here or to the marriage.

She has her own condo in her home country and a new car, and a career. For all I know there is already another man there helping her to pay her bills.

I have no idea what she is doing, and I don't even know her current address.

We only lived together for 5-6 months as a married couple before she left the country and abandoned her visa which had already expired.

She essentially deserted/abandoned me..

you should reread my stuff in your topic an re-apply what i've written in terms of divorce.

Sorry if I sound harsh, but you've segueway'd into something that really doesn't matter. Refocus on the state rules and guidelines for divorce,

and you'll find

that most of your concerns are unfounded,

as she's abandoned the marriage and you two were together for less than a year. In your previous response, you've responded as if you not study the state guidelines and rules for divorce.

Hey Darnell:

I have found a lawyer who actually does have experience with international family law cases, like mine. I did have a phone interview with her, and

she gave me some good information that assured me that I can get out of this fairly cleanly..

I have a meeting set up in the coming week to get the divorce action rolling..
