Hey everyone. So we're applying for Removal of Conditions for a temporary green card. We first got an extension for about a year. We just recently got an RFE asking for:

1) evidence of children

2) evidence that we live together and share responsibilities

3) evidence of shared financial responsibilities.

4) estate decisions.

So My wife and I have no children and no estate. We only have numbers 2 and 3 which we have submitted already. Would it be enough to just submit evidence for those two again? They would be different documents of course since we have more recent copies. Anyone have experience with this?

send what they are asking, bankstatements jointy credit cards togather, things that are finicial,your household bills,utility bills, rent receipts lease, morgage, file your taxes jointy,evidence of children there birthcertificates,medicals bills, copies of both driver license,copy of your insurances car, health, life,they want to see if your a bonda fide marriage happy an living togather you need to give them proof,

What have you already sent? It seems that is was found lacking.

Estate decisions = drawing up wills.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

thanks everyone who has replied so far.

I have to go over what I sent. however, I believe I sent them the following:

1) copy of our current lease with both our names on it.

2) copies of joint account statements

3) copies of joint credit card statements.

4) we also inserted other documents.

There's not much else we can send. We have no children, there are no wills or trusts set up. We have not set up power of attorney. We can send other copies of statements dating between 10/2011 when we originally filed and now. We have a dog and can send documentation with our names and address regarding that. I'm just wondering if that would be enough? If I call them, would they be able to provide a list of documents we already sent so we can avoid sending duplicates?

If you don't have a copy of everything that you've submitted, then you are .......... grossly under-prepared. You will likely have a better chance of winning the lottery than getting a list of what you've sent. That's your responsibility to know.

Now it's time to become engaged with this process and educate yourselves. Do some reading here on VJ where there are numerous discussions of what has been submitted with ROC filings.

Good to know. However, they actually provided a description of what we sent. One thing I noticed is the use of the word "continuous" and "continue" I don't think the government minces words, or at least I hope not. They seem to be interested in finding out whether we are in a "continuous marital relationship" and "continue to share a life together." so perhaps documentation that our situation is still the same and we still are sharing the same credit cards, bank accounts taxes etc. After all, a lot of the documents requested were the same.. Although, they cannot be exactly the same.

so it would seem that to prove such a thing, similar documents (which is what they are asking for) over a more recent period of time to prove continuity?

does that sound right? I mean I'm going to send them 9 months worth of stuff... and they won't reimburse the postage..<sigh> America... </sigh>

Also, anyone ever try these Info Session appointments for Pro-Bono legal advice? How did it go?

You don't need a lawyer. You seem to be overreacting. Search, or even just look, in this forum for ideas of what to send. This RFE is common, and not a big deal, but I agree with the above that you need to educate yourself about the process, and look for examples of what other people have sent. You need to send in different evidence than what you sent before.

The RFE is for evidence of a bona fide marriage. It is the same for everyone getting an RFE for this for ROC. One glaring omission in your list is joint taxes. No taxes?

You don't need a lawyer. You seem to be overreacting. Search, or even just look, in this forum for ideas of what to send. This RFE is common, and not a big deal, but I agree with the above that you need to educate yourself about the process, and look for examples of what other people have sent. You need to send in different evidence than what you sent before.

I believe we did send them taxes, yes. Just omitted it from the post. Ok.. .I'll take a look.

Do the documents you sent cover the period of your marriage? If you sent only the most recent statements, etc, they are requesting evidence of a 'continuous' relationship, for example, quarterly statements covering the period since you married.

Thanks for that explanation. I'm not sure if I can provide the full two years of stuff, but I will submit as much as I can. I can provide everything between the time the I-751 was submitted and now, and I'll keep looking.

You can actually send them stuff that goes back to when you submitted the I-485 for the first green card. You should include documents - bank statements; credit card statements; utility bills; joint expenses; etc for each year since you applied for the green card. I sent in statements that covered each quarter of the years since we had filed for our green card - which was the last lot of documents USCIS has for anyone who is applying to remove conditions.

What about Driver's licenses; vehicle insurance; medical insurance - who is on whose coverage; listing each other as an emergency contact at work or at school; rent or mortgage documents (or showing where the rent or mortgage is paid from a joint bank account if not both names are on these documents); yes, include the pet information from the vet and if you have microchipped the animals (both of our names are on our cats' microchip contacts). Health insurance and medical bills - copays come out of joint accounts? Show that. Cell phone family plans with both names; any joint loans (car, etc.); copies of cheques or invoices signed by both of you (not necessarily on the same cheque) paying for household expenses such as maintenance, repairs, service contracts, utilities; joint memberships like Costcco or Sam's Club; pension information - each listed as the spouse on pension or retirement documents with your employers; homeowner's or life insurance policies listing the other as spouse or beneficiary; You can still write your wills and include copies of those- there is inexpensive software available and you would just need to have them signed in front of a notary public with 2 witnesses. Bank safety deposit box with both your names; copies of magazine subscription covers showing name of recipient and address (for both of you); dry-cleaning bills; any type of daily living or household bills that have your names on them (you can each be paying some of them).

You received the RFE because you didn't provide enough proof of how you are and have been sharing expenses and responsibilities as a married couple since they last received documentation from you. They want to know that it continued after you received the green card and that it is still continuing. It is better to send them in too much information rather than not enough.

Same happened to me. You are not alone.

They do that to see if the marriage is legit because they believe "you can send new stuff since you are marriage" got it ??

Just send NEW STUFF or OLD STUFF that you never sent before.

Seriously, RFE are not a big deal. I learned that they do that just to update info since thet mght be running behind to approve I751s application.

Just resend again the proofs that you already sent with your original file and send more proofs that showed that you guys are married, like insurances, both of your driver's license or state id, letters that prove you both live in same address, proof of activities that both of you done.

Thats what I did when I got my rfe since they just need more because I sent so few in my original file.
