Hi everyone. I filed a K1 for my fiancee, just want to ask if I will have a problem regarding the support. I am self employed and just a few dollars above the minimum income requirment "line 22" on my recent income tax. my 2 previous income tax " 2009 and 2010" was way below the poverty line. what I want to know is if that will be an issue. BTW I have 3k dollars bank savings will that help? Another thing, do i need to send my 2009 and 2010 ITR, or the 2011 will suffice? Thank you very much.

With the last two years below PG and just a few dollars above the minimum income requirment this could be a problem. Can you find a part time job?

Probably going to be a problem yes. If you're self-employed you need to show three years returns. And if two of those are below, and only one above, and just barely, it's an issue. $3000 in savings is only capable of offsetting about $1000 in income, so that doesn't help you 'much'.

What's your household size? You need to include you and your fiancée, and include any children you have who are under 21 and unmarried. Also, include anyone you took as a dependent on your tax return. Does your fiancée have any children who will be accompanying her to the U.S.?

Also, what state do you live in?

You got me confused. I checked the website of US embassy Manila, only the recent ITR is needed. They haven't stated any exceptions or instructions that a self-employed petitioner should submit at least 3 tax returns.. Where have you learned that info?

This is what I read from USEM Manila website:

Fiancé(e)s (K-1), spouses (K-3), and returning resident (SB-1) applicants use the I-134 Affidavit of Support form. This form must be executed less than one year prior to the visa application. A copy of the sponsor’s most recent Federal income tax returns and evidence of current employment must accompany the I-134.

I can't say it's 'required', only what I read. I'm self-employed, so I sent three years returns. I can't say if they looked at them, but I believe so. They took all of it from my fiancé.

I'm not trying to scare you, not my intent. But you should know what you might be in for for sure. I hope you have no issues!

First off I filed a CR-1, yes it’s not the same affidavit of support as the K-1and yes the CO reviewed my 3 years of returns

The K-1 visa is a "non-immigrant" visa, as I’m sure you know, as such, it is subject only to the vague "public charge" provisions. but being only a few dollars over the PG and self-employed, you need to keep in mind there are no formal "instructions" for the I-134. Many consulates figure that since you will have to supply three years at the later date anyways, may require it for the K-1 i.e. the grant of actual "immigrant" status, when you file AOS it will require an I-864 which is an affidavit of support enhanced with contractual provisions. By statute it requires the last three tax returns or a legal justification for non-filing.
