Many biological parents in the USA DO NOT pay child support legally if they gave up the child for adoption, etc

This is really, REALLY simple and you're making it really, REALLY complicated looking for answers that don't exist.

VAWA is your only shot that you have right now. If VAWA doesn't work out, you can't stay here legally. You can stay here illegally, or you can go back to Canada or wherever you are originally from. You can't get a driver's license in NY without being here legally. That's it. It does not matter that your kids are USCs or that they have asthma or anything else because they are not going to be deported. ICE deports parents of USCs ALL THE TIME.

There is NOTHING you can do to change any of that. Either find out if you can file VAWA, leave the US, or lay low until your kid is 21. Those are your ONLY choices. No exceptions. None.

I hope I've read enough of this thread to offer a reply, and I'll probably be banned for what I have to say.

You say that Canada is not an option?! What happens if Immigration come knocking at the door and make it the only option? You are in the USA illegally. You entered and stayed illegally. You are probably working illegally, andf you come on here with your "boo hoo, feel sorry for me" story. It sucks for your kids if you get the boot northwards, and it could happen. You are also working illegally, which is a big kick in the teeth to those of us who did everything correctly and haven't found work, not to mention the millions of born citizens of this country in the same boat.

How is Canada any worse than NYC? Winters are bloody cold in NY, and the pollution is terrible. Every time I visit I need a shower afterwards, and if you'd ever looked in your tissue after a sneeze, you'd see it's not that favourable to someone with asthma. As many have pointed out, there are places in Canada that are a lot better climate and pollution wise than NYC. Kids have the same problem there, you know, and manage to live happy and productive lives.

All I can gather from this thread is that you want a new licence, so (presumably) you can carry on with your illegal work. If your kids health was a priority, then you'd move them to a different area, but no, it's NYC or nothing, and any help in me continuing my fraud would be greatly appreciated.

I think you have gotten all the great advice you can get here. Nothing anyone says will please you, because there is no easy way out and no easy answer for your situation. You are facing what many illegals face when they are about to get caught or running out of options: desperation. Get a good lawyer because you will need one. Get them Canadian passports just in case you are deported. I know you don't want to go back to Canada, but this isn't your country. I know you are trying to be a good father, so I wish you luck nonetheless!

Child support payment issues arent what VJ is about. Whether she has commited fraud due to not paying child support, while bad, is not even the point. Its not an immigration matter. I'm not sure want confirmation or information you are now looking for. Yes, she appears to have been a bad mother, but that was then and this is now. Many people give up their children, some for honorable reasons, others not so much. But I think you are clinging to this for reasons that are no longer clear. Do you believe this is a reason for you to gain legal status?

Not paying child support is not an abuse issue. If it were thousands upon thousands of USC would be in jail for abuse. You can pursue the matter in civil/family court but IT HAS NOTHING TO DO WITH IMMIGRATION so per your own statements to stick to immigration issues please stop bringing it up.

There are I believe three states in the US that will give a driver's license to someone with no legal status in the US. Move to one of those, move out of the US, or stop whining about it. You CANNOT become legal except by one of the ways you have been repeatedly told.
