1. Family Court judge who gave me Final Order of Custody in 2005, has also issued a second paper - confirming that we were married in 2000, before the births, and thus I'm the legal father.

2. She was never ordered to actually pay Child Support ONLY BY VIRTUE OF COMMITTING FRAUD upon the Support Court, where she got personally served to appear in 2006 - but VOIPed instead of appearing, and lied under oath

3. Your "stale-VAWA" call is based on the age of the 2003 assault conviction. But aren't 2006-2011 threats and Child Support avoidance are also grounds?

4. Is there something within VAWA or just outside VAWA about this: I'm a parent caregiver to USC children abused/neglected by LPR/USC parent ?

Thank you for coming clean finally.

She gave up the children and was not ordered to pay child support = not selfish.

Many biological parents in the USA DO NOT pay child support legally if they gave up the child for adoption, etc

This is really, REALLY simple and you're making it really, REALLY complicated looking for answers that don't exist.

VAWA is your only shot that you have right now. If VAWA doesn't work out, you can't stay here legally. You can stay here illegally, or you can go back to Canada or wherever you are originally from. You can't get a driver's license in NY without being here legally. That's it. It does not matter that your kids are USCs or that they have asthma or anything else because they are not going to be deported. ICE deports parents of USCs ALL THE TIME.

There is NOTHING you can do to change any of that. Either find out if you can file VAWA, leave the US, or lay low until your kid is 21. Those are your ONLY choices. No exceptions. None.

I think you have gotten all the great advice you can get here. Nothing anyone says will please you, because there is no easy way out and no easy answer for your situation. You are facing what many illegals face when they are about to get caught or running out of options: desperation. Get a good lawyer because you will need one. Get them Canadian passports just in case you are deported. I know you don't want to go back to Canada, but this isn't your country. I know you are trying to be a good father, so I wish you luck nonetheless!

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Child support payment issues arent what VJ is about. Whether she has commited fraud due to not paying child support, while bad, is not even the point. Its not an immigration matter. I'm not sure want confirmation or information you are now looking for. Yes, she appears to have been a bad mother, but that was then and this is now. Many people give up their children, some for honorable reasons, others not so much. But I think you are clinging to this for reasons that are no longer clear. Do you believe this is a reason for you to gain legal status?

Not paying child support is not an abuse issue. If it were thousands upon thousands of USC would be in jail for abuse. You can pursue the matter in civil/family court but IT HAS NOTHING TO DO WITH IMMIGRATION so per your own statements to stick to immigration issues please stop bringing it up.

There are I believe three states in the US that will give a driver's license to someone with no legal status in the US. Move to one of those, move out of the US, or stop whining about it. You CANNOT become legal except by one of the ways you have been repeatedly told.
