Hello VJers!! The I-864 is so confusing and yet so important. Any clarificaction would be appreciated!

I (usc) have been temporarily living abroad with my husband (applicant)since 2008. I have no income for the last 3 years in the US and thus did not file. According to 1-864 Instructions "If you did not have to file a tax return, attach a written explanation and a copy of the IRS publication showing that you were not obliged to file.

For general information on income tax obligations, or to request IRS-generated transcripts or copies of a tax return visit the IRS website.."

I also understand I have to prove my US domicile. Not a problem, I have bank accounts, CC, current driver license and student loans being paid monthly, all corresponding to my permanent US address.

So do I leave item 25 blank? The idea of leaving anything blank is nervewracking. Or do I just NOT check the boxes and list income as $0.00 for the last 3 years?

My mother is the only joint sponsor, will file 1-864 as well, and is well above the poverty line for her household (her, her husband and my husband).

I need ot get this right the first time and avoid any RFE!!

The US taxes on worldwide income. There is a foreign income exclusion of approx. $ $90k - 95k. So if you had income overseas that was enough to file, you should have even if no tax would be owed. See the IRS website for filing requirements.

If a sponsor has zero income for any of those years that amount is entered. Attach the statement that you referenced above.

The US taxes on worldwide income. There is a foreign income exclusion of approx. $ $90k - 95k. So if you had income overseas that was enough to file, you should have even if no tax would be owed. See the IRS website for filing requirements.

If a sponsor has zero income for any of those years that amount is entered. Attach the statement that you referenced above.

Thank you for the response. I did not have enough income overseas to file either. I went to Argentina as a student and have been supported by my husband and savings. A had a part time English teaching job which I stated on G-325A but the income was under US$6000/yr which I believe is the cut off for exemption.

I will have to double check the IRS website.

As far as attaching the qouted statement, that would be included in the exemption letter/ supplement letter explaining my situation right? Thanks!
