Hi,

I'm going to Europe for 2 weeks - leaving next week, and I have a few questions about the advance parole as I'm getting pretty stressed about this whole thing.

My background:

-I entered the US in August 2010 on a F1 visa

-Got married in January 2011 (been with my now husband for several years before that)

-Filed for I-485 and I-130, receipt date is September 12 2011 (it took us a while to put everything together)

-Had my last day of school August 28 2011

-Had our interview in December 2011, I thought everything went well, but they asked to see a letter from my school saying that I was actually enrolled during the past year and I did not have that with me, so I believe it stalled the process. I submitted the paper a few days later, but we have been waiting for a reply since then. In March 2012, after calling asking for the status of my application, I received a letter saying it was still pending and to contact them again in 6 months if I still don't receive a decision by then.

-We've had this trip planned for about a year now, so we applied for advance parole and received it.

Now my questions:

Considering my above situations, do you see any issues that could arise? I know that F1 students get a 30 or 60 day grace period at the end of their studies, so does it mean that I was still in good status from August 28 to September 12 when their received all my applications or was I considered illegal?

I still have my I-94, they should take it from me at the airport when I leave the country, right?

When I come back to the US, am I supposed to fill out the green or white paper? Or is my advance parole the document that will be stamped?

When going through immigration at the airport, can I go in the US line with my husband? Can my husband go with me if they take me to the secondary inspection room (which I believe always happens with advance parole)?

I still have my I-20 and not sure what I'm supposed to do with it. The school never took it from me or anything (don't know if they are supposed to?)

I think you should not have any problem regarding the entry, people who are out of status for a long time could face trouble but it's not your case. one thing that they could ask about that you came to the USA in F1 and you got married within 4 months , and you mentioned that u know ur husband long time before that [ my recommendation , not to volunteer and give them extra information which would make them question you about your intentions with your F1] in addition, I recommend you to have your school letter with you, since the IO couldn't verify your enrollment through SEVIS, maybe you will need that as well at the POE. I think the other members can assist you more regarding your other questions. Enjoy your trip

day 63-- 06/12/2012-- Received a Text & email for an update- Card production EAD/AP

day 77-- 06/26/2012-- interview / approved on the spot.

day 86-- 07/05/2012-- Received my GC in the mail.

ROC

day 1 -- 04/07/2014 -- ROC Package delivered to VSC

day 16 -- 04/23/2014 -- Walk-in Bio.

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014

day 202 -- 10/25/2014-- GC received

Thanks so much for your reply! I'll definitely keep the F1 issue in mind. We didn't really think about that when we got married, and I definitely did not see his proposal coming :) My intentions were never to get married when I came here on a F1, otherwise I would have just gotten a fiance visa... I kept studying after we got married so hopefully that'll help.

Does anyone know if I should fill out the white or green form when I enter the country? And can I go in the US line with my husband? I'd like for us to stay together as I know there can be a long wait in secondary inspection, and it would suck for him to wonder what the hell is going on.

You will fill out the resident form, as you are not a visitor. Yes, you can go in the US line with your husband. Whether or not they will allow him into secondary is anyone's guess. It depends on their policy and whether they have the room or not. You can try googling that particular POE for reviews.
