Hi all! Planning on sending out the AoS packet for the wife next week, and I wanted to run by you all the cover letter just to see if I'm missing anything. Some of the dates still need to be filled in, but I also thought this might help others searching for cover letter examples.

To whom it may concern,

Please find enclosed:

  1. Form G-1145 E-Notification of Application/Petition Acceptance for I-485 and I-765 applications
  2. Packet for Form I-485 Application to Register Permanent Residence or Adjustment of Status (and supporting documents)
  3. Packet for Form I-765 Application for Employment Authorization (and supporting documents)

My eligibility is based on admission as the fiancée of a U.S. citizen and subsequent marriage to that citizen within 90 days of entry.

Packet for Form I-485, Application to Register Permanent Residence or Adjust Status Includes:

  • Form I-485 signed and dated DATE
  • A personal check in the amount of $1070.00 made payable to U.S Department of Homeland Security ($985 I-485 filing fee + $85 biometric fee)
  • Copy of my foreign Birth Certificate
  • Copy of my entire passport including K-1 Visa
  • Copy of front and back of form I-94 (stapled on page 13 of passport above)
  • Two (2) Passport Type Photos (which were taken on DATE – Photos attached to receipt)
  • DS-3025 Vaccination supplement (Vaccination Documentation Medical Worksheet)
  • Receipt from doctor for K1 medical exam dated DATE
  • Form G-325A, Biographic Information Sheet
  • Copy of form I-797 Notice of Action -- Approval notice for I-129F fiancée petition
  • Certified copy of Marriage certificate
  • Certified copy of Sponsor’s Decree of Divorce
  • Form I-864, Affidavit of Support from sponsor (Husband, NAME) Includes:

    • IRS tax return transcripts and W2s for 2012
    • Employment verification letter
    • Copies of sponsor’s recent pay stubs

Packet for Form I-765, Application for Employment Authorization Includes:

  • Form I-765 signed and dated DATE
  • Two (2) Passport Type Photos (which were taken on DATE – Photos attached to receipt)

Copies of documents submitted are exact photocopies of unaltered documents and we understand that we may be required to submit the original documents to an Immigration officer at a later date.

Some clarifications...

We don't plan on travelling outside the country, and want to save money, so we are not filing the I-131.

Because our DS-3025 is filled out correctly, and we have a copy, we didn't need to see a civil surgeon, or fill out the I-693.

Because my salary is well above 125% of the poverty guideline for a household of 2, we can skip Part 7 of the I-864, and don't have to include documents for other assets (bank statements, mutual funds, etc)

Because we got married and are filing within 90 days of the K1 Visa (and because the guide doesn't include it), we don't need to include the I-130.

Correct? Anything else? Thanks!

The AP fee is waived if you file it with the AOS forms. I highly suggest doing this. Even if you don't plan on travelling outside of the country, you never know when an emergency can come up that you'd like to go back home for. The AOS process can take up to 8 months. In 2-3 months, you can have a work/travel permit. Why not file for it for free?

Oh, neat. I read that the I-765 fee was waived if filed with the I-485, but I did not see that about the I-131! Do you have a link for info?

Oh, neat. I read that the I-765 fee was waived if filed with the I-485, but I did not see that about the I-131! Do you have a link for info?

The I-765 and the I-131 both are on the same card. It's mainly the employment authorization, but at the bottom of the card, it will say "also serves as Advanced Parole"

Note: If you are filing Form I-131 Application Type B or D,you filed a Form I-485 on/after July 30, 2007 with a fee, and the Form I-485 is still pending, then no additional fee is due for Form I-131.

Quick question, then...I was going to bundle the I-485 stuff in an envelope, and keep the I-765 (and now I-131) separate, but now I'm wondering if that's necessary? Especially since the 765 and 131 are reliant on the 485 being filed at the same time. When it comes to the organization of things do they really care so long as it's all there?

Send it all together in the same envelope.

I kept them separated using paper clips.

You are missing the supporting documents for the EAD (and now AP). The AOS, EAD and AP are separated and sent separate places so yes you need to separate them (in the same envelope is fine, but separated) and yes you need to provide ALL the supporting documents for each form, regardless of if it was included with another form packet.

You can, but there's no reason to (assuming you don't already have a social security number).

 

It doesn't cost anything to apply for one (either in person during the 90 days of the K1, or with your EAD application), and even if you have no plans to work any time soon it's very useful to have an SSN.

I believe they ask for dates of travel if you apply for AP? What do you put down if you only need AP incase of family emergency? 

 

Also, Is the I-765 fee waived if filling together with I-485 and I-864? Can someone please confirm this because my I-94 is expiring in a week and I need to send the packet out before that time. Thanks in advance.
