I-864 AOS Questions

Part 2 - question 8 - I am sponsoring the principal immigrant named in part 2. (do i check this box and mark yes also? Instructions say this only applies to cases with 2 joint sponsors.) Should I just leave this section blank and do not check any boxes?

Part 6 - question 25 - Federal income tax return info - I have filed a federal tax return for each of the three most recent tax years. I have attached the required photocopy or transctipt of my federal tax return for only the most recent year. ( should i check this box even if i enter all 3 years below)

then it ask for total as reported on my federal tax returns for most recent 3 years.

Optional - I have attached photocopies or transcripts of my federal tax returns for my second and third most recent tax years. ( should i check this box also even when i check the box above)

IS IT OK TO JUST ENTER TAXES FOR ALL THREE YEARS ON THE FORM BUT ONLY SEND TRANSCRIPT FOR MOST RECENT TAX YEAR OF 2011? It says it optional but will it hurt if we dont send all three years? Makes me wonder why ask for 3 years if you dont need it. What has everyone else did?

Part 9 information on preparer. should I just enter N/A in all the spaces because im doing it myself?

Thanks any and all advice would be great. If anyone has anything to add please do. We want to get mother and father to the US ASAP.

If it is a joint return, you are going to have to break out your income from the total. Submit copies of your W2/1099 to show your part of the income.

Yes, you are sponsoring the immigrant.

Yes, you enter your individual income for all 3 years.

Question 8 is in part 3. Check the box and also check the "yes" box. Somebody has to sponsor the primary immigrant.

In the case when there is more than one immigrant based on the same petition, and if joint sponsors are being used, then two joint sponsors can split the immigrants between them. For example, if there are two immigrants - the primary immigrant and their derivative child - then one joint sponsor could sponsor the primary immigrant and the other could sponsor the child. The one sponsoring the child would check "no" because they're not sponsoring the primary immigrant. That's the only case where someone would check "no", and it's the only case where more than one joint sponsor is allowed.

Whether someone checks "yes" or "no", if they are sponsoring anyone else, either instead of the primary immigrant or in addition to the primary immigrant, then they check the box for question 9 and fill out that section.

You MUST send at least the most recent year's tax return or transcript, which means you must check the first box on question 25. You have the option of sending the returns or transcripts for the additional two years. In either case, you must enter your total income for all three years. If you submit only the most recent return or transcript and USCIS determines it's not enough then they may request you to provide the returns or transcripts for the other two years. They don't usually do that unless your current income appears to be borderline.

Leave it blank.
