Hello everyone, Hope VJers can help me answer some of my questions.

We applied our K1 visa last feb 2012. And we dont have any idea how this K1 visa process. We thought that after 5 months i can move to US then get married.So thats not gonna happen soon.

My questions are.

1. When the K1 is approved and move to US then get married, can I find a job after ? or do i need to apply for work Visa or something.?

2. From K1 then what?, what? before i can get my green card.

July 26.2013 (Day 58 ) EAD/AP approved Card in Production (july 26)

August 3.2013(Day 65 ) EAD/AP card recieved ( aug 3)

You need to read the guides and posts from folks moving onto the next step before you. Assuming your K1 is approved...

i) you move to the US - you will have 90 day from POE to marry

ii) you file Adjustment of Status (AOS) (fee = $1070-ish) after your marriage which includes employment authorization (EAD) and Advance parole (AP) for emergency travel if you have to travel back home before getting the 2yr green card (GC)

iii)once you receive the EAD you can start working in the US legally - you cannot (and you wouldn't want to try) to work before then

iv) 2 yr green card gives you a little peace - at the end of the 2 yrs you file for Removal of Conditions (ROC) and this gives you a 10 yr GC.

v) after the 10 card is received and you've been married for 3 yrs - you can apply for US citizenship if you like - or not

So basically about the next 5 yrs of your life belongs to USCIS :) Congratulations and welcome to the club. I would suggest you start reading about upcoming fees and look into how much $$$ you might want to have saved so you can live comfortably while you have a period of unemployment when you first move here. Read up in the AOS forum and get familiar with the next stage!

Once your I-129F is approved, it will be forwarded to either the Montreal or Vancouver consulate (Depending on what province you live in). You will then apply for your K-1 Visa with that consulate. You will have more forms to fill out, more pictures to take and you will have to get a medical done. You will also have an interview at the consulate. When you are approved you have 6 months to move, then 90 days to get married. Then you follow what Udella&Wiz said.

You cannot just move after your I-129F is approved, you have to finish all the steps to be legal.

12/31/2009 - Marriage

07/21/2010 - AOS approved

08/04/2010 - Green Card received (and it's actually green!)

05/30/2012 - Sent ROC packet to VSC

06/08/2012 - Received NOA1 for ROC (Dated 06/04/2012)

there is a guide tab at the top of the page..... read it! it will inform you of all you have to do.... and on the main page of the Canada forum there is a topic for either the Montreal or Vancouver and that will give you all the info you need for after the initial application is approved.

It's not just an apply in the states and you go..... there are steps that the beneficiary has to take too.... good luck

Has anyone said READ THE GUIDE on thw k1 page?? lol Everything u need and more is there. Its not that people do not like answering your question, BUT they are less likely to respond to this type of question when its all found in the Guide! And when it time comes to AOS, holey moley, there is even a guide for that,lol Best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
