Hello VJer's,

I already post my situation last year, Now there's a changes of applying tourist visa for third time. I will give you some info regarding my live in partner. She petition her mother U.S. Citizen. We got 2 kids after 10 years of living together and they left me because they are now immigrant nor U. S. LPR as of now. For almost 3 years, my live in partner and my 2 kids goes back to our country to get married. So, we got married last April 1, 2012. Since, the petition as a F2A or IR1/Cr1 of me is too longer (no petition yet). My wife wanted to reapply tourist visa. She sent me I-134, ITR and bank statement for the seek of my interview. Is these documents can help me for my interview? What are the possible question by the CO? Could you pls. help me regarding my situation. Thank u for your reply.

If your wife and 2 children are in the US with green cards I do not think that you will be granted a tourist visa.

The documents that she sent will not help you. In fact, they could hurt you as it shows that you have a spouse working in the US.

The best thing is for her to file a spouse visa petition.

Hello VJer's,

You must prove strong ties to the PI in order to get a tourist visa. That would be a very good job, property, other assets, and family. You have family in the US--strike one. You do not mention whether you received the visa the other two times, if you were refused then that is strike two and three. You can try for a tourist visa, but expect to be throwing your money away. I would have your wife petition for your thru the spousal visa or I-131. It may take 6-9 months, but you would then be together as a family and you would be a LPR of the US.

Hi Ahn Map, and Dave, Roza,

I understand that it's difficult to get tourist visa if you have a relatives in the U. S.but then nothing is impossible to ask God. Any way, best on my research that if you are US citizen you can file spouse visa petition but If not you just wait until you become naturalize. Am I right or wrong? I got a ties such as house and lot, personal life insurance, and share of stocks, and job including other medical and SSS benefits from the private sector. I wanted to know what is the specific visa petition of my wife if she still LPR and fast way to join in the US? I-131 is a form for Application for travel document, is this form that you can petition you spouse outside US? Can my wife petition me as a CR-1 and it takes 6-9 months? I'm happy to granted in short period of time. Pls. guide me more as God will bless you. I'm very thankful both of you your reply. Again, thank very much.

An LPR spouse can petition for you. They'd file an I-130 for F2A visa, spouse of LPR. This can take upwards of three years though, so during that time if your spouse naturalizes, the petition/visa is upgraded, and handled sooner.

The best path is that she files for your spouse visa now using the form I-130. If she becomes a citizen before your interview then she can upgrade the petition and your interview will happen sooner.
