Hi

Just sharing our experience with the New Delhi embassy. They havent been very responsive on phone.

But yes they replied to our mails -

I am a US citizen residing in Mumbai. FYI my details -

I am going to file I-130 for my husband. From the information I have, I cant file it at Mumbai consulate and needs to be filed at Delhi consulate.

Can you please tell me if I need to do this in person? Do I have the option to mail the form, documents and fees to Delhi embassy.

I need to fly to US for employment soon and wish to file the petition at the earliest. My documents are ready but just need to know how and where?

I have been trying to call the Delhi embassy and talk but had no luck there.

Would really appreciate if you guys could respond at the earliest.

Dear Applicant:

Thank you for your inquiry.

The USCIS at the U.S. Embassy in New Delhi accepts I-130 petitions from U.S. citizens who reside in India. Physical presence is must for the U.S. Citizen and the beneficiary for filing the petition. The length of stay is not the criteria to prove the residency requirements. The U.S. citizens whose principal residence is not in India, and/or are abroad temporarily as a visitor or on business, must file the petition in the United States. If the U.S. citizen is not eligible to file in New Delhi, he/she should file the petition with the U.S. Citizenship & Immigration Service Center having jurisdiction over their place of residence or last residence in the United States.

You may provide evidence and supporting documentation to meet the criteria. An assessment of eligibility to file in New Delhi will be made after the required evidence and supporting documentation is reviewed.

The I-130 filing fee is $420 needs to paid in the form of US Money Order in USD or local demand draft in INR. The current exchange rate is Rs.58 and equivalent filing fee is INR24360.00

Other replies

There is no need for any appointment. You may appear on any working days Monday to Thursday 9am to 1pm to file the petition. It usually takes the same to accept the petition if the documents required are found to be sufficient.
