Based on what you have stated, so far, I don't think that there should be any problems with the immigrant visa. You only applied for a tourist visa and it doesn't matter whether you are married or not to apply for just a tourist visa.

Really ? Especially when husband was already in US, it did not matter at all...

Yes. If you have a spouse in the US, it's not a problem to lie about your marital status so you can fraudulently come to the US. No problem at all. US government is so stupid.

I asked my father today he said that the officer didnt ask any thing to him about me..

He just asked to him that why we are goin? General questions like this..

We just marked single instead of married in non immigrant visa..

N i think this is not big isuue.. As many people do alot of faruds they make false cases and all that but we didnt fraud any one... My case is geniune and true.. We just marked single instead of married.,.. Just on the basis of this they cant band me..

And according to my attorney he said that this wrong marking comes under human error, or etc...

just because others commit fraud and get away with it doesn't make it right. the fact is that you lied, no matter how much you try to convince yourself that it will be OK, it is going to be a hard fight. IT IS A BIG ISSUE. Being naive and defensive isn't going to get you a visa when you misrepresented yourself in order to enter this country. Get a good lawyer and open your eyes.

However, you may be asked or have already been asked, while filling out your paperwork, whether you have applied for a visa before. And, you need to answer this question correctly because USCIS will have a record "on file" of your tourist visa application.

please don't post incorrect information. Misrepresentation at any time , on any visa, is fraud and carries a lifetime ban. It is not OK at any point to lie to the US government in order to gain entry into this country.

You can apply for a waiver after you have been denied, not before.

Stop posting wrong information on here.. the OP has been given GOOD and Correct advice!!!

you can file single married or however you want to but in the end if you were married would need to go back and AMEND the previous year when you filed single... to show you were actually married!!! IF not you risk frauding the IRS!!

The OP has been given correct advice and GOOD advice already but the US LAWS are that she is married... My nikah is good enough to show to the US gov we are married so by US LAWS they ARE MARRIED! HAS NOTHING TO DO WITH HOW YOU FILE YOUR TAXES!!!

  • She applied for two tourist visas/once when she was married and was denied
  • she SIGNED an application saying she was single when she was married
  • Her father told the co she ws single when she was married
  • now he husband is filing a spousal visa for her and Ive asked if he put she NEVER applied for a visa before on the forms but she hasnt answered that but if she DID put she never has then thats basically double trouble

ANY LYING on FORMS OR INTERVIEW IS TOTAL MISREPRESENTATION!!!! She may not have realized at the time of the tourist visa interview but she was old enough to read the forms and know what was on those forms and she knew she was married but the form said single. *disclaimer.. we are guessing it said single since her father said she was single at interview*

THEY NEED TO HIRE A GOOD IMMIGRATION ATTORNEY/she says they already have

She should from now on tell nothing but the truth and answer honestly and pray for the best because right now it doesnt look good but we wish her the best and hopefully the attorney is very good

I filed the same way

I have small children and work full time and of cos my husbands not home (still in AP) so I met every criteria for filing Head of household

i get denied

after this my husband applied for me ir1 visa

i was scared too and i was crying too much

all peopel here say i will get denied and bla bla

let me tell u

u didnt do big crime and us ambassy are not stupid lot of people do this and its not big crime

my husband went to see lawyer for amigration in usa and she said no worry this happen all time and all people do

she say now we r doing right thing and if our marriage is real one we will be fine

u r not the only one

and u will not get denied

dont listen to people here they only scare eachother and give advice and information from google

if they give u tourist visa and u went to usa and u over stayed there after u applied thats will need waiver but now u will be fine and u will see

i wish u good luch and pray for us

Thx alot.. I was very upset and even i get angry on my hubby too coz i fell in depression after reading here that every one was saying that i may get denied..

My hubby also went to our lawyer n our lawyer said the exactly same as u are saying.. I was in very tension for last 1 week even my blood presssure fell down :-(

I totally disagree with you. You need to be practical here and there is no need to give someone false assurance without any authentic evidence. If you read the instructions for the tourist visa or any visa application for the US, it clearly states all the information needs to be accurate and correct. You CANT misrepresent the facts. Who knows she might have denied at the first place because of this lie. Also, the US government keeps all the records of your interview questions/answers as well as what do you answer at the port of entry. Do not take them lightly and it's a really BIG deal. Ask any immigration officers that it's not a big deal and everybody does that and let's see what he/she does with you. It's like killing someone then saying that oh it was a mistake but now I'm doing everything according to law so I should not be punished. I would imagine that your husband was in the US and he still let you lied in front of the officers.

Also, at the same time there is no need to take tension which affects your health. Everyone here is trying to help you and not to scare you without any reason. Pray to God that you won't be asked any questions about your tourist visa but if they ask you be honest with them. Also, get your all questions answered by your lawyer. Correct. My friend did apply for his wife, before that his wife tried to get tourist visa lie to them and told them that shes not married and she doesn't have nobody in US.after that when she got intervew with counsel, they ask her how long you have been married, and she gave them wrong and not tru answer, because she told them we married already 4 years but 2 yeras before she tried to come US, but lied to them that she isn't married, and they refused the visa and denied because of lies and they show to her all answers and what consults ask her. So my poin is for now my friend he can't resolve this problem its already 2 years. US embassy they righting everything what was you've been ask and your answer and they using your lie on your interview day against to you and refusing visa and denying your case. Better to get refused for tourist visa telling them that you going to visit your husband or fiancee instant of lie, and on your interview day for sure they will see how you've been honest with them and they wont use refusal against you never because of tru..good luck
