You are so freaking wrong.

You could have obtained an ITIN to file as married. Have you not heard of married filing separately?

Furthermore tax laws has nothing to do with immigration laws. The only requirement about taxes and immigration law is that the US petitioner must file tax returns or show a legal reason why he/she was not required to file. Essentially if you don't pay your taxes, you don't get to petition for your family. Notice that immigration never ever ask what you marked as your marital status on your tax return. Immigration only asked how much do you make and do you meet the 125% poverty line.

How is the husband filing for his wife? Isn't he applying based on being married?

Please explain to me in your world how a husband can be married in the eyes of the US government, and his wife is single? That doesn't make sense. He has to be married to someone.

You are not single. You marked single because you wanted to commit fraud against the tax and not pay the married filing separate rate. The right answer for your taxes was married filing separate. When immigration sees you claimed to be single on your taxes they can also claim your marriage is fake and deny because you claimed to the federal government that you are single.

Damnnn u folks : ) hey Maha everything is fine u dnt worry By US law u guys still single ? lets i try to explan. when we going to file tax return so we cant filed as a married.... ? becuz wife dnt hve SSN... still check mark on single, if anything wrong or missing so u guys correct me

you can file single married or however you want to but in the end if you were married would need to go back and AMEND the previous year when you filed single... to show you were actually married!!! IF not you risk frauding the IRS!!

The OP has been given correct advice and GOOD advice already but the US LAWS are that she is married... My nikah is good enough to show to the US gov we are married so by US LAWS they ARE MARRIED! HAS NOTHING TO DO WITH HOW YOU FILE YOUR TAXES!!!

  • She applied for two tourist visas/once when she was married and was denied
  • she SIGNED an application saying she was single when she was married
  • Her father told the co she ws single when she was married
  • now he husband is filing a spousal visa for her and Ive asked if he put she NEVER applied for a visa before on the forms but she hasnt answered that but if she DID put she never has then thats basically double trouble

ANY LYING on FORMS OR INTERVIEW IS TOTAL MISREPRESENTATION!!!! She may not have realized at the time of the tourist visa interview but she was old enough to read the forms and know what was on those forms and she knew she was married but the form said single. *disclaimer.. we are guessing it said single since her father said she was single at interview*

THEY NEED TO HIRE A GOOD IMMIGRATION ATTORNEY/she says they already have

She should from now on tell nothing but the truth and answer honestly and pray for the best because right now it doesnt look good but we wish her the best and hopefully the attorney is very good

My husband concerned with ou lawyer yesterday.

Our attorney said to us that this is not big issue.. Many people do this.. We didnt do any crime aur fraud.. At the tyme of interview in 2010 the officer didnt ask me any thing. He was just asking from my father. And yes we filled single at that tyme..

My attorney also advice me to tell truth when i got interview letter this tyme..

Attorney said that this is not big crime and my marriage is geniune, my hubby has submitted all his taxes and my documents all are right..

If officer asked me about my previous visa then i will tell them true..

I hope that this will not create any big issue. Further my attorney said that if they denied me just on the basis of one mistake which is not so big and serious then he will send letter i dont know which letter.. But i wish that all thing go good..

Then you don't know how to file your tax return with the correct marital status.

If you think you are single in the US, then try to marry someone else. Give it a shot. See what the US government will say about you being married to two women.

Just because you chose wrong on your tax return does not make you single.

The US tax system is self-reporting. This means that the government relies on the taxpayer to correctly report his situation. Lots of wrong things get through. Only a select few tax returns are actually reviewed and audited. The US government does not review or audit every tax return it accepts.

I didnt mark single this tyme..

I marked single when i was applying for non immigrant visa..

I think that there is no concern with immigareant and non immigrant visa...

The comment was for Kas17 who is giving the WRONG information because he doesn't know how to correctly file his tax returns and is completely unaware that the US recognize foreign marriages.

Here i want to correct all of u my friends that the officer didnt ask us any thing about my status in 2010..

He just asked to my father that y we are going and all this type of general questions...

We just marked my status single instead of married in 2010 in non immigrant visa..

there is no human error when you know your married and you mark single... and sign the form

however since you were not trying to gain benefit of immigration on the tourist visas they may ask for a waiver.. a good friend of mine had his wife also lie on her tourist visa to usa years prior to meeting him and they were denied the spousal visa but given the opportunity to file a waiver and it was accepted.

please dont be in denial this is serious not like a bit of spilled coffee on the application and if the attorney is certain this isnt a big deal.. FIND A DIFFERENT ATTORNEY!!!!! One who specializes in situations as this...

I just want you to go into this with enough education to know what to do and how to handle yourself.. im not trying to make you feel bad but its soooo important you get someone that knows about this so they can help you!!!! Hopefully you will be lucky and this wont cause an issue but you must be prepared... i wish you the best!!!

What is waiver?

simply put its a form to fill out telling you need to be with your spouse and that the error causing the denial of the visa is considered waived

it has to be applied for and accepted...

My best advice to you now is do LOADS of research and know what your up against... obviously it won't be as smooth as before but it's not completely impossible.. just educate yourself and make sure you know what the attorney is doing at all times!!!

Ok if the form is accepted then can i get visa?

if they require it then you submit it...

research all this information you've been given.. no answer we give will be exactly what happens.. we've explained to you that lying on any form for the gov is misrepresentation

we've advised you to be sure you get a good attorney who specializes in this area

just understand that no two cases are the same and islamabad is very inconsistent we've had 3 flat out denials just days of eachother at the embassy so please just research and educate yourself

Based on what you have stated, so far, I don't think that there should be any problems with the immigrant visa. You only applied for a tourist visa and it doesn't matter whether you are married or not to apply for just a tourist visa. However, you may be asked or have already been asked, while filling out your paperwork, whether you have applied for a visa before. And, you need to answer this question correctly because USCIS will have a record "on file" of your tourist visa application.
