Want to make sure about something....as far as CRBA requirement for " 5 years residency " is it 5 years time of being present in the US as US citizen or it doesn't matter ( i.e : like the time spent as permanent resident also counts towards that "

I'm asking this because one can apply US citizenship 5 years after being permanent resident.... so I was confused on why they would say that I have to be a US citizen and a minimum of 5 years of residency ( or maybe it's said that way, to rule out persons who go married to a US citizen and got his/her green card from their spouse and after 3 years they got their citizenship instead of the normal 5 )....

Thanks all,

As I said in my original post, any time you were physically in the U.S. counts --before and after naturalization. It's 5 years of physical presence -- that is, 5 years when you were physically in the U.S. Residency allows you to travel outside the U.S. as a permanent resident (vacations, visiting family back "home", work, etc.), so the two do not mean the same thing. As an example, if you were in the U.S. for 5 1//2 years prior to the birth of your child, but you spent a total of 7 months visiting your home country or on vacation in another country, you would not transmit your citizenship to the child -- you would be missing one month of U.S. time. You shouldn't have a problem showing 5 years total if you've been in the U.S. for 10 years.

I was in the same exact situation that you are in.. I would suggest emailing the NVC to expedite your case so that they forward it directly to the embassy. That way you can make your appointment right away. I just emailed them saying that my wife was pregnant and I really wanted to be in America when she had the baby, and asked if and how I could expedite our case. They emailed me back saying they would review our file and let us know if we were approved to have our case expedited. 2 days later they said it was approved and they were forwarding everything to the embassy. It didnt work out and I had to get the CRBA anyways, but maybe you will have more luck than I had..

Oh man that's great for you. And congratulations for your baby girl....

Yes, definetly we're the same case here... the email that you used to contact NVC is the same that USCIS provided in the NoA ( NVCINQUIRY@state.gov ) or is it another email address ?

Thanks,
