Hello,

I'm considering visiting my fiancee in the US next month, traveling on the visa waiver program. We received our NOA1 in February but have heard nothing since then. I stayed for the maximum three months on the VWP from September-December 2011, and February-end of April 2012. We accepted that I wouldn't be able to come across again via this method until the K1 visa process was completed. However, due to a serious family situation on her part, I really need to be with her as soon as possible.

Could anyone tell me whether a) this would be possible given the circumstances, and especially if we can provide proof of the severity of the situation, and b) who to contact to get verification that this would be ok.

**** Moving from K1 to Tourist visa, as question pertains to VWP *****

1. It is possible, but not guaranteed, as you already spend 180 days in the last 10 months there. If you are let in, chances are you will not get 3 months. If you ask for 2 weeks or a month, and have a return ticket, you probably have a better chance.

2. No-one; it is up to CBP the day you attempt to fly.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
