Hello,

I am an Italian citizen studying in the US on a F-1 Visa. I will be finishing my studies soon and wish to stay in America to work. My mother has American citizenship through her parents (both Americans, but had my mom in Italy and have been living in Italy since their 20s), but has lived in Italy her whole life. She has filed a I-130 petition for me a few years ago in the thought that when I graduated from my university, my priority date might be arriving soon. It was approved through the first few stages, but we are still waiting for more approvals/interviews/etc. However, I have decided to continue studying for an advanced degree in America, but I will need to get a new F-1 visa. I have heard it is possible my F-1 will be rejected because I have filed for a I-130. Is this likey? If so, would it be better to cancel the I-130? If I were to cancel though, would that affect my chances later on if I reapplied or tried to get a work visa?

As long as you can satisfy all the other requirements it should not be a deciding factor.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
