First of all, let me express my sincerest condolences for your losses.

Answering your question, the instructions of form I-751 say the following: "Filing with a request that joint filing requirement be waived: you may file this petition at any time after you are granted conditional resident status and before you are removed".

My deepest sympathies to you and your family.

You can file for ROC on your own, and I believe you can go ahead and file now and not have to wait until the 90 window before your card expires. You will need to send a copy of his death certificate and the usual evidence that your marriage was bona fide. http://www.visajourney.com/faq/k1k2visa-removeconditions.html#7.11

I am so sorry for your loss, you will rejoin in the after life.

As of your questions, as a conditional resident, in case of spouse death or divorce you can file to remove the conditions on your resideny after having the divorce/death certificate. When you file I-751 to remove the condition, it will give you the option to choose to waive the joint signature due to the death of the US citizen through whom you got your residency.

For a list of all required documents fees etc, please go to the removal of condition forum,

Again, I am so sorry for your loss, we all feel for you.

YA ALAH Bless Our Joureny To The End , Ameen

I am so sorry.

I lost my wife at the age of 31 almost two years ago, so I know some of what you are going through. It is also our wedding anniversary on the 5th.

You have already received good advice regarding filing the I-751 early. You should have no issues doing that.

I wish you the best.
