AOS sent, after 1 month and 10 days; no response.

Hi guys!!

My AOS was originally sent on Apr 2/2012, on Apr 12/2012 we receive a notice that the AOS was received but that there was something wrong in the AOS form, there was a missing signature, we fix it and sent it back with their respective documents, coversheet etc. on May 23/2012 (i know, if it was just a signature why it took us a month to send it back to NVC? that's a long story... ...my father was busy with his other daughter's wedding).

But hi told me he sent it on May 23/2012

But after 1 month and 10 days i have not received any notification saying they have receive it.

and when i enter to this webpage:

i receive this notification:

explain yourself better...are you talking about adjustment of status???

why is this!?

When was the RFE due by? Are you sure your father did send the form with the signature in? Did he use any trackable method? It may be that they never received it and the date to respond has passed. Call the NVC and see what they have to say--make certain to get to a supervisor or even higher to determine what is going on. You may have to refile the whole AOS if the next notice you get is a denial for not responding to the RFE.

what is RFE?

date to respond? my email is the only one that figure in all the papers, since my father doesn't have email, so if there is any communication to my or my father... i should have received any.. in all the process, so if any response was needed they should have notice me first.

RFE is request for evidence which in your case was the notice to return the document with the signature. Typically they put a statement that you must respond by such and such date. Did you receive a hard copy in the mail delivered by the USPS? Did your father use a trackable method to send the reply back to the NVC? If so, was it actually delivered and when? The NVC and USCIS have not moved into the electronic age and still do the official things thru the US mail. I would ask your father how he mailed back the response and hope he used a trackable method. If he did not, and you do not hear anything, I would call NVC to see what's up with your application, but I would expect to refile.

mm.. oh ok, but i dont think the missing signature was requested as a RFE, because RFE is for something EXTRA, because they already sent me a RFE a year ago for other paperworks.

In this case they didn't gave me a time limit to answer them back (NVC), the typical ".. if you don't contact us within one year.."

I rely in what you are thinking... Did he really sent it?

he says yes.. but i will insist in which method he chose, and i'll call to NVC.

i just wanted to know if AOS paper works were ok, would this delay be ok, but apparently it is not.

Griselita, is this your F1 petition or something else? If it's your F1 petition, how are you doing AOS (adjustment) if your priority date is 27-JUL-07 (according to the watch list)?

ETA: Or do you mean Affidavit of Support instead of Adjustment of Status?

i have news

My father gave me a phone number to ask for the case, but i decided to contact them by email instead.

On July 6 i sent an email to NVC asking about the case, if they have received the AOS form properly signed (because mistakenly my father forgot to sign it), as i told you they usually answer between 3 and 7 days after they receive any paper/form etc.

And i was asking if they have received it, because it was sent and i haven't had any notice from them...

Well, on july 17 (two days ago) i received this email from NVC:

Dear Sir/Madam:

The National Visa Center (NVC) received your inquiry regarding the immigrant visa petition: SDO2011XXXXXX filed by XXXXXXX XXXXXX on behalf of XXXXX XXXXX XXXXX.

Immigrant visa petition SDOXXXXXXXXXX is currently on a list of completed cases awaiting the availability of visa numbers. This petition will be eligible for an immigrant visa interview when a visa number is available per the Department of State's Visa Bulletin. The current edition of the visa bulletin is available on the following website:

i suppose i should be happy, right?

But i still WOULD like to know why they didn't notify? (is that normal?, no notification once case is completed after AOS has been sent?)

And i'd like to know the date the case was completed (for the timeline/records)

It's the US government. They are notorious for this. Have a look around this forum. You'll see countless posts from people who never received an email notification, or never received an I-797 they were expecting to receive, or never got their AOS fee bill, or never received their green card, blah blah blah. It happens. A LOT! You just need to be aware of when you're supposed to receive something, and start making phone calls if you don't receive it within a reasonable amount of time.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

It's the US government. They are notorious for this. Have a look around this forum. You'll see countless posts from people who never received an email notification, or never received an I-797 they were expecting to receive, or never got their AOS fee bill, or never received their green card, blah blah blah. It happens. A LOT! You just need to be aware of when you're supposed to receive something, and start making phone calls if you don't receive it within a reasonable amount of time.

Oh, ok i didn't know that, i thought there was something wrong with my case.

so this is the first time it happens to me :hehe:

and... what's next? the interview date? how do i know when will be?

Hi..

i forget (i really dont remember if i knew it) how to check the visa availability for my case

My am F1 with priority date of 27Jul2007.

i used to know how to check the remaining time for the NVC and the USCIS.. but at this stage... which of the cut-off date is the one i have to keep the ye on it.

my father constantly call me to ask me how is this progressing that this shouldn't have take more than 5 years and stuff like that...
