Hi VJ friends,

I thank you all for support and help me whenever I needed for my visa journey. You guys are simply awesome.

Today I am here in need of some help:

I had my ritual temple marriage in Nov 2009, but legal registration was done 4+ months later. Based on situation, I think, legal date would be considered as marriage date for immigration purpose.

I arrived in USA after 2 yrs anniversary from the legal date of marriage, but I was given CR-1. I made a note to Custom Offical, he looked my doc, but just didnt care. I guess he was lazy, and he didnt even ask me any question at POE. I didnt bother to repeat myself as that was my first POE, so didnt want to cause any trouble there.

I have searched on visajourney for the same issue, and I understand that if anyone who arrives after 2 yrs marriage, he/she is entitled for IR-1.

Today I booked an infopass in Fort Myers, Application Support Center, and there was no real help, but the offical said that it really depends up to custom offical whether they want to admit as CR-1 or IR-1. He looked in his computer using my A number, and told me that I am admitted as " CONDITIONAL " resident.

I asked if I should file I-90 and mention it as USCIS error, he said I am free to contest but no assurance for success. I asked him whether I should put original green card with I-90 but he said, I better just add photocopy of green card and covering letter.

Wondering what should I add with my I-90 and how should I make my case stronger that USCIS made an error.

I think, I should write a covering letter, marriage certificate copy, green card copy. Anything else should I add?

It would be great if you guys may share some stronger point that I should mention in covering letter, so my case looks stronger.

10-04-2011- Case Completed 10-07-2011- Called NVC and Received Interview Letter by email
NOV-2011- Interview (AP)
06-05-2012- Visited at Embassy Second Time
06-08-2012- Received Message from VFS Collected on 11th asking for New Medical
06-12-2012- Medical Done Send Back on 14th
06-25-2012- Received Message From VFS Collected on 26th asking for New Passport Clearance gone be Expire on 28th.
07-10-2012- Send Back New Passport & Passport Clearance
07-16-2012- Received Message Collected on 17th July He Got His Visa.(less then 8 months)

08-08-2012- Green Card Received for 2 years

05-12-2014- Apply for I751 at California

05-23-2014- Received letter said tht apply for I90 (incorrect card because of uscis error)

Legally you need to have your greencard on you at all times. Do not mail it away!!

Bad advice. Correcting the green card requires the actual card go in with the I-90 filing. Keep a color copy of both sides but file the I-90 with no fee and include a photocopy of a certified copy of your marriage certificate plus a certified translation. Explain that since the entry occurred after the two-year anniversary of your legal marriage, that you are entitled to IR1 status and request the card be corrected and replaced.

The person above gave advice without reading the I-90 instructions. Send the card.

Facts are cheap...knowing how to use them is precious...
