SSN applications for K1 and K2, K-2 A#?

Hello all,

By the end of the month my fiancee (K-1) and her son (K-2) will be arriving at POE Seattle. The fiancee and I will be getting married 4 days after arrival (3 day waiting period per WA state law). I am thinking that I should take them down to SSA office so that they can apply for their SSN as soon as possible. I don't see any issue for the fiancee. As it stands now, it looks like she will be keeping her maiden name for simplicity. However, does the 19 yo son (May birthday) need to have EAD document or any other document(s) prior to applying for his SSN? I have read the AOS guides and the K-2 supplements/sticky notes, and am a bit confused as to the most efficacious course of action.

We are planning to file AOS (I-864, I-485, I-131, I-765, I-693, G-325a) for both of them shortly after the marriage and medical work-up. Regarding the son's application forms, I do not believe that we have an Alien number for him. It is my impression that it is through the AOS process that he will have his Alien number assigned. I am assuming that I will leave that field blank on the application forms.

The K-2 AOS guide and subsequent thread at the top of this forum is very good, I just need some affirmation/clarification if we are taking all of the correct actions, and in the proper sequence. Your comments and advice are appreciated.

As a K-1 they can get a SSN after waiting 2 weeks so their entry into the US is entered into the system. If you go any sooner than that you take the chance that they don't have record of entry into their system.

For the soon to be wife, take her to the SSA office about 10 days after arrival just to be safe that she is in the system. I would take notes on date, time, office location, and the people you deal with. Take her BC, passport, I-94 and the K-1 as proof she entered the US legally on a K-1 so she is an alien legally admitted authorized to work for the SS-5 form. Do not mention the marriage since she wants the SSC in her maiden name. You should get the SSC in about 10 days or so. If you have any problems you can 1) ask to speak to a supervisor or 2) leave and e-mail the main SSA office listed on their website and explain your situation. You should get an e-mail you can use to educate the employees that a K-1 is allowed to get a SSN as long as there are more than 14 days left on the I-94.

For the son, he will have to wait until the EAD or GC before applying for a SSN. Currently his A# is associated with his mother's file so it is the same. Really not sure if you should leave it blank or use the mother's A#. Don't you include him on her AOS form that he will be adjusting with her? Sorry, not to familiar with the K-2, but I think you file a single I-485 and include the son on it as you check 2C and then list all children and mention that they are adjusting with you. That A# I would leave blank and then he will get his own during the AOS process.

Dave, thanks for the info. The fiancee's info makes sense. However, some of your comments (in italics above) about the K-2 son seem in contrast to the forum's K-2 OAS tips. I can understand with your thoughts about waiting for the EAD before applying for the son's SSN. The issue of the K-2 A# seems vague to me. Maybe I just need to read and read the subject more. Now you see the confusion I am speaking about. :unsure:
