Hello, i am wondering how to cancel a CR-1 petition. I am looking for information for a co-worker and here are the details i have.

The packet was just mailed out yesterday so it hasnt even been received yet however they have decided to cancel this process. Is she able to just put a stop payment on the check? Does she need to call USCIS (what is the phone number) or write a letter stating to not process the packet? Will they send the packet back to her?

She needs to stop that check immediately. Cuz once they receive it they will not and do not refund. Once she has stopped check call USCIS with follow up to tell the,. They will deny the petition and send back to her.

There is no phone number that will handle this. The package goes to a central facility and then is routed to a processing center. No one will be able to pull it out of the "stack."

Stopping payment will stop the process.

They might send the whole packet back. If they do, no worries. If they don't, then send a letter "withdrawing" the petition. Neither the office in Chicago or Phoenix will know they stopped payment on the check until after they case has already been sent to California or Vermont. Usually, when there's a problem with the payment (like the check bounces) the case remains in the queue and they simply pursue collection of the fee.

Send the letter to "hereby withdraw" the petition, to the address on the receipt notice.

Stopping payment on the actual check may not work since USCIS converts the check into an electronic debit. You should go into the bank and talk to them about which is best, stopping payment on the check or stop payment on electronic drafts from a specific company (USCIS in this instance).

if I were you just go the bank that issue your check and tell them bank stop make the payment to the check number that you have write to make your payment of. then send a request letter cancel the pack to the filling location. that your package have send too.

A cheque is a signed and written contract between two parties. Once you sign and deliver the cheque you CAN NOT revoke the contract, unless you can prove fraud on the other parties part. So unless the USCIS has defrauded this person they will have to honor the contract. The USINS has rights to the monies. To stop payment can cause very serous problems. I am not a lawyer... And I am not giving advice. But I did get in some serous trouble myself, for making a stop payment on a cheque.

Actually, if you can successfully stop payment on the Check, and then send a letter withdrawing the petition, that will probably end it. However, it is most likely too late for that.
