Good day Guys! Need your advice!

Me (beneficiary) and my wife (US Citizen) soon planning to send our AOS Package.

My wife has three kids from her previous husband but they weren't legally married. She has never been legally married. And her previous husband was jailed and registered as sex offender about three years ago.

Plus she is eight years older than me, different religions and she was once jailed for six hours for fighting drunk. Other than these, we have have a lot of co-mingling financial documents like Joint accounts, car, health insurances, utility bills, and apt lease to our names. Plus a lot of family pics. We have been married for three months.

Do you guys think, her previous husbands criminal record would be trouble for us during the interview or background check?

Do we have to show her previous husbands name on our application even though they weren't legally married before, but has 3 kids?

Does the age and religion difference would raise any red flags

If they weren't married, then she has no previous husband. I don't recall anywhere on the AOS paperwork where you have to list previous boyfriends. His criminal record shouldn't affect you at all.

The age and religion could raise red flags, and by that I mean cause some extra questions. But hopefully it's nothing you can't overcome. Sounds like you have a lot of strong evidence.

So the fact that they had 3 kids doesn't matter if they weren't signed as husband and wife.

I can't see why it would. I suppose they might ask her where the father of her children is at the interview. But I don't see why it would give you any trouble.

No. But she needs to earn enough for a 5 person household or get a co-sponsor.
