I posted about two years ago in hopes of bringing my wife to America from Thailand however I was unable to find a sponsor. The situation has changed for the better. My goal is the IR-1 visa though I am uncertain if I should pursue the DCF path. I am still in Thailand with my wife but my family wants me to come home asap. Is it possible to start the DCF path and continue it while in I am in America?

Below are some other general questions that I have as I finish up my i-130 package.

1: can I send scanned copies of my marriage documents and other relevant proof to USCIS or must everything be originals?

2: My co-sponsor has already filled out an AOS and from reading the checklist I think I must fill one out as well. Is that a correct assumption?

3: On the pre-interview sheet it requires the long form of my birth certificate. Can I use my passport instead?

4: What other fees that must be paid other than the $420 application fee?

USCIS yes copies are fine. Originals you will need at the 2nd stage NVC

Your AOS papers won;t be needed until you get to NVC. Oh about 3 to 6 months after you file. And yes even if you didnt make a penny you must also fill out a I-864 you are the sponsor no matter what

Yes you can, You are only proving US citizenship

With you I130 filing yes its $420. Once you get to NVC you will pay $88 for your AOS filing and $230 for your IV Bill (Visa Fee)

Looking perfect. You might want to fill out the G1145 so you can get ext and email of when they received it. Know this you may or may not get notification that way. Its a hit or miss. Many of us just got the hard copy of our receipt.

Yes you can, You are only proving US citizenship

I've lived and worked in thailand for nearly five years now and been married to my wife for nearly 4 years. Would it be easier to file directly with the embassy/consulate in bangkok? What would I put in my income bracket on my AOS since I do not have a job in America? Would I list my debts (ie college loans) and my bank information both in America and in Thailand? What would I do for my employment letter if my place of employment in Thailand is unwilling/unable to provide such a letter? In the Ir1-cr1 guide states that "6. A copy of petitioner's proof of permanent residency. (If applicable) ". How would I go about getting this if my residency is in Thailand? Would my landlord, who is Thai, have to write an affidavit stating my residency and have it translated into english?

If your wife has ever had a Visa she would have been assigned a number. If not a NA in the blank

Sorry list all in the last (I forget lears they say. For my husband I had to have an attachment wasn't enough room for long names and addresses. Sorry

They only list assets if their income isn't meeting the guidelines. And assets are calculated at 3 to 1 (I would read the guides more on that one)

Police certificate you have a good 6 or 7. Months before you will need that. That's needed with the actual Visa application when your case goes to the NVC. So hold on.

5: Would it suffice to print our photos (proof of marriage etc) on a4 paper?

Sure printing on regular paper is fine. How ever you want to display. I did 8 X 11 paper for each pic.

If ur embassy has DCF use it. Be sure to check the uscis.gov website to be sure they have it.

You would not list debt there isn't any questions about debt no need for that.

Your employment letter would do no good. You need to show an employment letter of current employer here. Where u are being taxed in the US. Otherwise yes you have to provide all your co-sponsors info.

You should go to the thread NVC July filers. The first post takes about how to show proof of domicile in US. Since you have a few months (about 6 to 7) I would start doing those things if you haven't already. Nothing you have in Thailand will help in this matter.

Nope no need. You need to show domicile in US.

Forgive but I did not quite understand the answer to this question. I am going to restate a few questions that I had in a previous post to make it easier to answer.

1: Would it be easier to file directly with the embassy/consulate in bangkok?

6: in the I-i30 form I am unable to fully write my wife's middle name. I just need one more space/letter. Would it be ok to pencil in that letter when I print this the form off?

7: section 21 asks for the time that my wife and I have lived together. We have been continually living together for the past 5 years. Would it be permissible to write "08-29-2007 to present" in the application?

8: How would I explain gaps in my employment history over the past five years?

When u are ready to file ur affidavit of support regardless of ur income you have to fill out and you would put 0.

Since you say you been in Thailand 5 years you don't have I gather any income tax filed for last 3 years?

I have done my taxes for the past five years as required by the IRS even though I have been in Thailand the entire time.

Your employment letter would do no good. You need to show an employment letter of current employer here. Where u are being taxed in the US. Otherwise yes you have to provide all your co-sponsors info.

You should go to the thread NVC July filers. The first post takes about how to show proof of domicile in US. Since you have a few months (about 6 to 7) I would start doing those things if you haven't already. Nothing you have in Thailand will help in this matter.

I would to stay with my wife for as long as possible while we take this journey together. What's a few months when we've been together for five years? Is that possible to do without showing that I am domicile?

Wouldn't such a letter show that my wife and I have cohabited together?

I meant to ask if he needs to prove that he meets the financial requirements to sponsor someone. Assets are indeed calculated at a 3 to 1 ratio.

Guess that the best way to get questions answered around here is to have them numbered. Please forgive me if I have violated some forum rule, spoken or otherwise, by posting as frequently as I do.

1. Yes and yes.

2. Later, yes the joint sponsor will comply with the requirements of the I-864. Download and study those instructions.

3. You can just indicate where you plan to live and show you've still got a driver license, bank accounts etc. This also comes later.

It's possible you've been ignored because the answers to these questions are in the guides and form instructions. Careful study of both will be critical to your ultimate success.

I had my joint sponsor fill out the i-134 form. Does he need to fill out the i-864 form? My bank account was closed due to inactivity and my driver license has expired. Do I need to have those activated before she comes to america with me?

Later, yes. Start with the guides. There's no affidavit of support in the I-130 package. Study, really.
