The other day I filed two I-130 petitions in the embassy in Mexico City: one for my wife and one for my adopted son.

The petitions were accepted without any problems. But now there's a detail that I just now realize.

In Mexico, all people have a paternal last name and a maternal last name. I want him to use only my last name in the US.

I was paying such special attention to other details to make sure my son's petition was done properly, that I wrote his last name with both family names on the forms. However, my daughter, for whom I did a CRBA, is already registered just with my last name. So this is what I want for my son as well. I don't want two different last names for them!

The I-130 petitions have already been submitted. What can I do now to make sure that the visa and subsequent legal paperwork is processed with just my last name, as is the case with my daughter?

Regardless of what is on the paperwork (I submitted most of the paperwork in my maiden name because I wasn't sure I wanted to change my name). The visa will be issued in the name in the passport and the green card in the name on the visa.

The quickest and easiest way to ensure it is done to your liking is to change the name on the child's passport

You can ask at the interview but there is no guarentee that A)they'll remember when it comes time to print the visa and B) do it anyway

Good luck

Thanks. When I filed my daughter's CRBA, I asked about this specifically: Which name do I write down on the form? My last name, being just the one last name that is standard in the US or both as they appear on her Mexican birth certificate The response: whichever you want to use there. So her American passport was issued with my last name and her Mexican passport with mom's and dad's last names.

How is it, then, that with the visas, they'll just use the name from the Mexican passport??? How is that my kids will have two different last names?

I'm focused, concerned, and even anxious enough as it is to get the visa for my son, so I don't want to cause obstacles with the last name, but this is an issue for me.
