They decide IR1 or CR1 based on the date when you filed your petition I-130 at USCIS.

What, really? But the website says otherwise.

"Remove Conditions on Permanent Residence Based on Marriage

Your permanent residence status is conditional if it is based on a marriage that was less than 2 years old on the day you were given permanent residence. You are given conditional resident status on the day you are lawfully admitted to the United States on an immigrant visa or adjustment of your status to permanent residence.

Your status is conditional, because you must prove that you did not get married to evade the immigration laws of the United States. To remove these conditions you must file Form I-751, Petition to Remove Conditions on Residence."

11 JUN 2012 - NOA2

NVC - MEP

2 JUL 2012 - Case Received at NVC

19 JUL 2012 - Case number, IIN and Beneficiary ID received, gave e-mail addresses!

23 JUL 2012 - Was able to log in and fill out the DS-261 and I made myself the agent! I also stated that I was assisting the beneficiary ( since I signed in as him )

24 JUL 2012 AOS fee available and paid through the payment portal - direct deposit

25 JUL 2012 AOS fee shown as paid!! I-864 package e-mailed to NVCelectronic@state.gov

01 AUG 2012 IV Bill Invoiced and paid

02 AUG 2012 IV Bill shown as paid and DS-260 completed and documents sent!

08 AUG 2012 RFE! :crying: sent passport photos wrong, so re-sent!

15 AUG 2012 case COMPLETE!!! Yay!!

13 SEP 2012 Received Interview Date! OCT. 5th!

20 SEP 2012 Scheduled ASC appointment by calling 7034392313. Two days earlier I logged into the website but it said there were no appointments available. But when I called, they scheduled an appointment for me. :)

I have seen that link before as well. But I have also seen another example (occurred in November 2011) where one of my friend's wife after being married for 2 years and 1 month she entered in USA on CR1, and she also got her green card as CR1 only. Her husband filed a petition before they were married for 2 years.

Okay I got my case number on June 22nd. I stil am unable to pay my aos bill and send my info. I called yesterday and they said they were processing my electronic processing email. I asked why it was taking so long, since I know others get theirs within a day or two and she said "well I can ask my supervisor but it will take at least 15 days to get a reply". REALLY? I am so tired of the run a round. Every time I call I get zero help. Any suggestions? :angry:

NVC operators are dumb and just read out whatever status info they see on screen for your file. I never found them much useful besides getting status updates.

I thought the CBP officer at POE makes the decision on IR1 or CR1. For NVC-USCIS-consulate purposes - it is the same.

But I have also seen another example (occurred in November 2011) where one of my friend's wife after being married for 2 years and 1 month she entered in USA on CR1, and she also got her green card as CR1 only. Her husband filed a petition before they were married for 2 years.

I some what agree with your point of view. But if your reason is correct why NVC assign IR1 category to case.

I some what agree with your point of view. But if your reason is correct why NVC assign IR1 category to case.

Was yours assigned as IR1? I assume it was CR1 only. In my assumption NVC gets the category assigned by USCIS and they don't change it by themselves. I may not be correct, but I have also not seen an example where person was on CR1 during the process, and immigration officer stamped as IR1 at POE in USA. If someone else has seen it, then please speak up!

OMG...this is exactly how I FEEL...no CASE NUMBER AGAIN TODAY! It's been 15 days! What do they say??? Call back MONDAY! So what if it doesn't arrive on Monday? Is there another way to check if your case has even ARRIVED ON THE SCENE??? I'm thoroughly aggravated because the NVC operator was so hasty and pushing for me to get off the phone! UGH! :ranting:

Since you have been married for over two years now, I would start the process to change it to the 10 year visa. I know that is a headache...and I don't know who you would ask about "Should it have been handled differently when it was actually issued or if they will do anything about it at this point." Oh, I've been extremely patient. :innocent: Only called the NVC three times in the 15 days I've been waiting. I'm proud of me! I guess I was just expecting them to step up to the plate and lay it out for me this morning. :rofl: Yeah, right! What was I thinkin'? :bonk:

Looking at your NVC time line below I have a question. Can't both of these packages be paid at the same time and sent in at the same time? What if you want to submit a money order and not pay online? Does this mean you do not need to wait for the barcoded sheet but would only need the NVC Case number?

Looking at your NVC time line below I have a question. Can't both of these packages be paid at the same time and sent in at the same time? What if you want to submit a money order and not pay online? NVC payment portal allows to make payment only thru Checking and Savings Bank Account. AOS bill generated in 1 day after my case number was created and IV bill was generated when they accepted my DS-3032 form. I could have waited for both to be generated and make payments at the same time, but I did not want to waste time on that.

I have not tried to use money order / cashier's check option.

This link has different mailing address to send your AOS check.

NVC will send AOS invoice email with pdf file attached to it with email subject as "<NVC Case Number> (PAOSF I-130 FOR NEOPOST DS-1200)" It has alternative payment instruction as well. Make sure you attach this pdf invoice in your AOS package, instead of barcoded sheet that gets generated thru payment portal after making online payment.
