F1 Student Visa with approved I-765

Hi,

I am currently on a student F1 visa and have been approved my I-765 visa and have been working for a few weeks

I am from Scotland United Kingdom and im wondering if i should be having tax deducted from my pay??

any help is appreciated.

You are legally working in the US? I believe that you should be having taxes taken off. So that begs the question...are you having taxes taken off?

i recieved my first pay cheque today and it seems that i have had tax deducted from this

i was in college for the last year and was working 20 hours on campus, this was before i had the I-765 approved.

When i was doing this there was no tax decuctions on my cheque

Then I suggest you speak to your HR rep or someone in payroll. You do not want this to come back and bite you. If you are legally working in the US you are required to pay taxes - don't let this go by and do nothing.

In my opinion, the only thing scarier than immigration law is tax law (I also stole that from expert immigraiton attorney Laurel Scott, she offers free chats on Wednesdays if you want to post your questions there)

When you were working under the student visa your pay was correct without taxes being taken, but since you are working under a different visa taxes should be taken. Everything has been done correctly.

I just wasnt sure, i was told that I didnt need to pay taxes until i am a full citezen but wasnt sure if this was correct

I am also looking for information on what visa to apply for bext as my f1 runs out next may

Students are generally still being covered under their parents taxes, therefore when you are a student the business can opt not to withhold taxes. Since you were working under the student visa, they did just that. When you file income taxs next year since you are a international student you will file all income regardless if tax was taken from that income, since your parents will not be filing US taxes.

In the end the tax taken verus income will all even out.

Even as a student on F1 your taxes should have been withheld, 99% you would have to everything back at end of the year but your taxes including your SSN and FICA should had been taken off your pay check.

Will you makr less than 6,0000 for the year, then no taxes, if more take taxes because you will have to file income tax next year.

For someone in payroll to tell you that they have never dealt with this issue before, means you are talking to the wrong person. Working in payroll, they should now the tax laws.
