I'm sorry if this is the wrong category.

I came from Sweden to the US on June the 3rd to spend this summer here with my boyfriend. Now, I don't want to leave at all.

Last monday, my boyfriend was diagnosed with cancer: lymphoma. Yesterday, they did a biopsy so in the beginning of next week we'll find out what kind of lymphoma it is.I hope and pray that it's not one of the most aggressive ones, and that he will be alright. He's young and strong and positive, and I pray that he will stay positive. I need to be strong to, to support him.

In 2 weeks he will start his treatment, which will last for 6 months and longer.

I wish there was something I could do, to be able to stay here. Of course I wan't to follow him through his treatment, but to me it seems kind of hopeless to be able to do so.

I just don't know what to do.

have you thought about marriage? you clearly had no intentions of staying when you came, so it might be a good idea if you adjusted status while here, nothing wrong with that.. you will be able to get an advance parole, so you wouldn't have to wait till you get a green card before leaving the country in case of an emergency back home.

We have planned to get engaged and apply for a K1-visa. But the situation is different now.

I guess we would have to hire a lawyer if we get married this summer and so fort. Lawyers are expensive, and I don't know if we have that money. :( But of course this is a option that has crossed my mind.

You don't need a lawyer, but if you want to stay with him for longer duration you will have to get married.

you can do it by yourself.

Am sorry about your boyfriend.

Unfortunately, there's no way of lawfully staying beyond the i-94's expiration date if just wanting to stay - you'll have an overstay and not be able to use the VWP again. VWP can't be extended. And there's no way of adjusting status as a girlfriend/fiancee of a US citizen.

On the bright side - you entered the country legally, have already talked about marriage/getting engaged in the future. Your only way of adjusting your status will be to marry and adjust status from tourist visa(VWP) - there's a guide here on VJ that'll be helpful, and plenty of people willing to help. If you don't have any socalled red flags, then a lawyer seems a bit over the top.

The thing that matters is that you were inspected, and the CBP officer determined that you showed no immigrant intent. Your stamp in the passport is proof of that which you'll have to include in your AOS package.

I'd start looking into the Swedish documents required from you since you might need some help from family/friends to send them to you. Just remember only to include copies of your documents in the AOS package - you keep the originals and bring them to the interview.

Marrige is a hugh responsibility, being that your bf is sick if you'll marry you will become responsibile for any medical debt that he should incurr. Think this through completely, there is more involved than being by his side while he gones thru treatment. You are from a country that allows you to visit for 90 days without a visa, don't think rushing to marry is your only option.

Um...why would she tell the CBP that she is visiting her boyfriend who has cancer? Obviously she needs to tell the truth but she doesn't need to divulge any additional info

Good luck OP - you cannot lawfully extend your stay in the US based on tourist status. Your option is to marry ASAP and adjust stauts but this should not be taken lightly.

If you want to marry, marry now and apply for adjustment of status. That way you do not have to leave.

OR

Leave and come back with VWP.

OR

Leave and apply for a tourist visa.

How big is the chance that I'll be rejected and that this will be considered as a visa fraud? Is it just a matter of luck, or do you think I'll be ok?

As mentioned, I didn't intend to stay here after the VWP expired, but this situation has led our thoughts to do it this way now.

Our relationship is serious, and we had already talked about/planned to get engaged and marry in the future.

I doubt you will be denied based on fraud. Cancer isnt exactly planned! I hope you manage to sort your immigration situation out and that your boyfriend has a speedy recovery.

Chances of the rejection should not be very slim, provide the supporting document as letter from medial facility, which should show the day your BF was diagnosed with Cancer and the treatment he will be going thru.

If you are ready to get married and would like to stay besides your BF thru the recovery, get married and file for the AOS and include documentation to support your reason and you should be good.
