Hi Guys,

My husband and i applied for my green card on January 5th, (from a fiance visa) and no issues..for that, i had my biometric taken..all good..got my work authorization few months ago (and its considered as travel too), i have an SSN ...but still waiting for green card. its been almost 6 months( 5th of july)..and nothing. somebody called USCI for us and they said, that im not going have an interview, they are waiting for somebody to review it and approved it... but why its taking so long?? if there is no RFE? or Interview?

I worry, only because im coming back to Algeria for my wedding and i dont want have to deal with algerian gov, that maybe will not understand my paper work and i will have issues to comeback to the US, knowing we have a wedding planned here too...

any advice? in how to check where my file is really..? and when i should start calling everyday for my Green card?

Thanks

Work authorization is not going to get you anywhere when you are out of the country. You need to make sure you have an AP.

AP is advanced parole. You could have applied for it at the same time as AOS and EAD. It allows you to leave the country while your greencard is in process.

what is an AP?

The I-131 is the form for filing for Advance Parole(AP). AP gives you permission to re-enter the US if you need to travel outside the US while waiting for your green card to be approved. EAD is only for work authorization. You cannot use it to re-enter the US if you leave. You can still file it now and send a copy of your I-485 receipt from filing and the fee will be waived. However, it takes 2-3 months to process. Do not leave the US without AP or your green card.

Cases transferred to the CSC are taking more than 5 or 6 months now to approve. Have a look through the progress forums to see how long others are waiting and those that filed at the same time as you: http://www.visajourney.com/forums/forum/131-adjustment-of-status-case-filing-and-progress-reports/

does your EAD card have it written that it can also be used as I-131 Advance Parole (AP) card also. if yes then you should be ok to travel. just make sure your card isn't near expiring if it is then i would not travel.

yes, my EAD is as an advanced parole too..sorry i should have mentionned that before.

i went to mexico earlier this month, with a mexican visa the wya out, the way in it was okay, i just had to spend un hour explaining my document to the checking people, that called immigration in florida,i spoke to them and all was okay, but i lost one hour and almost missed my flight. back in US was just some formalities with immigration at airport, they just asked quick questions about trip..and took to the back room for same reason and then gave me a paper..all was fine..i just dont want have to deal with same issues in algeria as mexico ...it so annoying!

my file was transfered to california knowing it could have been handled in texas faster.

Ahh, so you did file the I-131 and get the EAD/AP combo card.

Always seems to be some hassle or another going through the immigration process. Hopefully the CSC will start approving those green cards faster, or send them back for interview so people can finally get approved. Good luck! :)
