Hello friend,

I married to USA citizen girl that why i got the conditional temporary green card just six months ago which is expire in august 2013.Right now our relationship is not going well. We are not divorce yet. But our relation is going in that way divorce might happen in near future.

After I will divorce ,I want to remarriage. So I have some question regarding that as under.

1.After divorce ,Have I file I-751 immediately or Can I file I -751 before the 90 days of my conditional green card expire?

2.After divorce in conditional resident visa (CR1) , Can I eligible to remarriage with USA citizen girl?

3.If I will do the remarriage with USA citizen girl then, can I put the new file for CR1 visa behalf of me? In this situation , must I have to inform USCIS about remarriage? Must I have to file the I-751 before the put the new CR 1 file?

4.If I file the new CR1 visa , then any matter occur about my old marriage mean Have I prove old marriage was went in to faith condition ? I have proof about that It was in good faith.

5.In this situation , I do not know about immigration law , So, am I break any rules Of immigration ? So I will be careful about that…

Thank you very very much for advising me….

You file for divorce. Once divorce is finalized you file I-751 ROC on your GC. IF approved you are a LPR with a 10 year GC. All you have to do to remain in the US is maintain your LPR status. I find it sad that you are worrying more about your immigration status rather than putting some effort into saving the marriage.

You will have to prove the marriage was entered into in good faith and not to just obtain a GC--I hope your proof is good becuase the USCIS tends to look at these a bit more closely to make certain that the marriage was not for just the GC--so I hope you are prepared for that extra scrunity.

Good luck,

Dave
