Indian-American attorney advises Indian women considering marriage with US citizen to use K-1 visa

With increasing numbers of fraudulent marriages being reported in the US, a leading Indian American attorney specialising in immigration laws says it is important for women to understand the US immigration laws and visa categories and check the groom's antecedents.

Anu Peshawaria, who practises law in Fremont, California, said: "This happens because women, mostly from rural India, believe that marriage to an overseas Indian is a passport to a good life."

Peshawaria gets an average of 30 such cases a month.

"A woman should make full use of the fiancée visa - or K visa - before getting married to someone in the US," she suggested. The K visa allows the fiancée of a US citizen to enter the country provided she gets married to him within 90 days of her arrival.

"Ninety days is enough time to check on the groom's antecedents - where he lives, what his profession is, how his family is," Peshawaria, who runs SevA, the legal aid unit of the non-profit organisation India Vision Foundation (IVF), said.

As for other options for battered or abused women, she said there are a number of legal options but women are either not aware about them or do not take resort to these.

"If the wife is abused by her husband or his family, she can always file a VAWA," she said.

VAWA (Violence Against Women Act) allows battered immigrants to file for immigration relief without the abuser's assistance or knowledge, in order to seek safety and independence from the abuser.

"If the basic idea is to go to the US, there are a large number of visa categories that a woman can apply for other than those for marriage," Peshawaria suggested.

"Remember, marriage is not the only ticket to the US," said the 1982 Asian Games tennis bronze medallist and sister of well-known police officer Kiran Bedi.
