Hi there everyone,

I've been searching trying to find a similar situation to this one but I can't so please any advice is appreciated. I was living in Peru for 2 1/2 years and while there I met someone, we dated seriously for 2 of those years, lived together and then I decided I needed to come back to the US to start pursuing my career and that we would look at the option to have him come here and study. We haven't been together romantically for a few months but we applied for an F1 visa at a local university so he could do english classes and we'd have time together to see how our relationship unfolds (get back together, stay friends etc). I listed myself and my savings etc on his DS-160 and I-20 as his sponsor for the F1...trying to do things legally. He went to his visa interview today and was rejected because the embassy official claimed that it looked like he was coming to the US to marry me and why would a young woman be offering her savings like that for a guy to study english etc. So he didn't get the F1. In all honesty, we are both devasted. We tried to be honest because we are NOT together and would have had him return home and file for a K1 if we WERE to pursue the marriage but now it is a disaster because I'm listed as his sponsor on this denied F1 and I'm worried that if we decide to file for K1 fiance or if we marry in Peru in the future it will be a red flag that we are committing fraud. Its so frustrating because I was trying to do this the right way and got us in MORE trouble and in the process realized how much more I want to be with this person.

The nuts and bolts of my question are:

Will this F1 denial and me being associated with it as his sponsor cause a problem if we decide to pursue a fiance or spousal visa in the future?

How long should we wait to apply for that after this incident so as not to raise any MORE red flags?

Thanks

Applying for a K1 or spouse visa should not be hampered by the F1 filing. It actually makes more sense to the interviewer than the F1.

Its really not a red flag more than half the petitioners here probably were filing visitor or some other visa before we went the K1 or CR/IR1 route. Its of no surprise to the CO's. You were honest and if it comes up at his K1 interview he would explain just like you just did. No harm no foul. If you two are engaged and want to marry you can file anytime. There's no wait limit. But you just said you were to see how it would work out so I guess you two aren't there yet.

So is he here in the US or back home now?

You stated you guys not a couple.

IMO. Were you to quickly file either k1 or cr1 it would only validate the original denial. You guys attempted to commit fraud by immigrating on the applied for visa.

You should definitely document all contact to be able to provide proof of ongoing relationship, should you choose to marry

He is still in Peru as we just got the F1 denial this week. Im thinking of goong down to Peru to visit in August then filing for the K1 after that. We just wanted a chance to have him come here study and see where things go but by sponsoring him as a "friend" for that it seems we royally messed up. Do I getto provide evidence of this if I file the K1 to explain ehy we were looking at the f1? I guess all our previous evidence of the relationship is shot to hell now after claiming we were friends not more. How long should i wait to file k1 so we have a chance? Do you think its a likely denial???

The time wait no matter cuz you will be tin the system forever with a denied F1. The issue may come up with you providing the evidence since you will have submitted evidence that crosses over this denial unless you show evidence after you filed.

I mean look at it like this, you filed a student visa said you were just friends no you are going to submit evidence of an ongoing relationship when you meet all that when they see wow they were talking relationship back when they said they were friends. Just be ready to explain either way because a "friend" you were sponsoring now is your fiance'.
