Hi, everyone!

does USCIS forward the NOA2 over to NVC or just the petition of I-130?

Thank you for putting answers.

Well the NOA2 is your approval notification your I-797C hardcopy letter that you will get in the mail. The I-130 petition moves forward to the NVC approved in the database. Is that what you mean?

**FYI NOA2 is just a VJ term used**

Yes, that was what I meant. Well, I haven't receive the notification I-797c hardcopy yet, USCIS said they would mail it to me within 45 days since 6th Jun,2012,but they said had forwarded my case to NVC at the same,too. SO does that mean I count the dates since I got the notification hardcopy or I can ignore the NOA2 paper just call NVC after a month since 6th Jun, 2012? It has been 22 days, I wrote to NVC, but they said haven't got my petition yet.

Yes, that was what I meant. I would call NVC everyday now. Maybe USCIS as well, i know snail mail is slow but 22 days? I learned last week that other country's can use EP now but I have no clue if that would be the reason for the delay.

Well this is the deal with NVC. I am sure they got your case its just not logged in system. Meaning no case number for you yet. I have been reading there's quite the back log. Well, actually I got a notification from USCIS, told me not to contact NVC until after 120 days, but my husband is a USC,I don't have to wait for the perior date to be avalaible, why do I have to wait for 120 days,right? And it's their fault to mess up my case, I indicated to have a interview oversea,but they send me a wrong approvement paper, when they finally corrected the status they told me not to contact NVC until after 120 days. I just thought maybe it won't really have to take 120 days to get a case number, so I just wanted to tried if any luck I can get it in a month. Because onece the file has been forwarded to NVC, the next step would be like anyother USC's spouse, get invoveld in the electronic plan and interniew,right? Or maybe I am wrong, I really have to wait till 120 days, lol. What should I do though, guys? It's really appreciate to get your anwers. Have a good day!

Well I dont know what you are asking them for them to say wait 120 days. You have the AOS and IV bill (well your husband does ) te fee to pay all the documents you have to send in your police report all that than you case gets completed and an interview date is set. So maybe 4 to 6 weeks at the NVC stage u will be.

But you need to call everyday and request your case number and IIN number thats all you want so you can start processing your next forms. Do read the links in the NVC June filers thread.

also you said "I indicated to have a interview oversea" where are you now? this may be why they said wait 120 days I don't know.

I was in the US for half a year with B2 visa,my husband mailed the I-130 to Chicago before 2 month I left the US,I wasn't going to AOS in the US and of course we indicated to have a interview in China in the form. Somehow they send me a NOA2 to AOS in US and I'm in China now. My husband called them to correct it , USCIS said they are sorry about that and will mail another NOA with 45 days but the case has been forwarded to NVC,but not to contact NVC until 120 days.

Friend, what do you think of this case?I wonder if they put a extra 1 infront of 20,lol. Because even some AOS people change their plan to apply to go consular processing only takes another 90 days before transfer it to NVC. So I really don't know what the 120 days is .

Sorry I did not get the whole detail of your current situation. But If I am not wrong, your Petition was approved on June 6th 2012 and yet to receive I-797C ( Notice of Action) hard copy.

What actually did NVC tell you when you contacted them??

If they say, NVC received the CASE and yet to generate CASE NUMBER, you are in good shape. dont worry. NVC is backlogged these days and it is taking almost a month to generate a CASE number.

If NVC did not receive your CASE then You have to follow up. First make sure the mailing address you provided to USCIS is same where you are at ( your husband). To do further process at NVC on your situation( missing approved Petition) , you have to have copy of NOA2. It might be good idea to cut the Screen shot of your approved case from USCIS website.

If NVC still tells you that they don't receive your CASE by next week, Talk to Tier 2 at USCIS and notified about your situation. Hope it helps....

My husband will try to call NVC next week. I heard some of the May filers takes 33 days to get the case number. They wrote to NVC everyday for the case number, but NVC never replied they got her case, just yesterday they said never received her petition, but today she got her case number. doesn't make sense to write to NVC,no matter who write to them, the answer will be the same, lol.

The entire casefile, OTOH, is sent to NVC.

Please look into Electronic Processing with NVC - that casefile is headed to Guangzhou and you'll save some 'dead zone waiting time' by using EP.

I have read things about EP for thousand times, but I don't have the case number, so I can't do anything. That's the most fustrating thing .

You have resolution on that, yet? Regardless, the Petitioner should be talking with a Tier 2 Human at NVC until this is resolved. If this means a phone call every two days, so be it. USCIS made a procedural error in your casefile, and it's on your husband to make them aware of it and also request that the casefile move to NVC. It's not automatic, he has to use a telephone, get the right human.

see ISO - http://www.dhs.gov/files/publications/gc_1305658440339.shtm and understand the difference between Tier 1 and Tier 2. Tier 1 humans are useless for the thing yer husband needs to do.

USCIS did mailed us a piece of paper said they did make a mistake, will send us another NOA, and they said the case has been forwarded to NVC, that's all. Does my husband have to call them again to make them transfer my case?
