This is a question for a family friend.

She(dominican)is married by law and has two kids under 4 both of them, but her husband{s(dominican) sister(dominican) applied to bring him to america before he was married (years ago)hes gonna get his papers on october to move to united states. can he bring her and the kids with him? or what is gonna happen with them? whats the process?

K1 Visa Process -> 12/09-06/10 Married -> 09/10/10 AOS Process -> 09/10-12/10 Removal of Conditions-> 09/12-07/13

I am the USC, husband is adjusting from B2.

ADJUSTMENT OF STATUS

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved

Ok. So from my understanding she is married legally in Santo Domingo? And her husband sister applied to bring him to the USA before he was married? Therefore I'm assuming since the sister petition for her brother and only the brother, he CAN NOT bring the kids nor the wife, because he was petition my his relative, so that mean that eventually when he comes to the state he can start his own process to try to bring his wife and kids to the states. My question is being that he will come to the states as resident won't he fall into the categorie of a legal resident petitioning for a minor and/or unmarried child where it can take up to 10years? so that mean this can take up to years to petition for a wife or kids to come. Unless he fall into the 3year to become a USC and apply for them like that. I may be wrong. But it clear that if his sister petition him, and him only and at the time he wasn't married nor with kids, that mean he wouldn't be able to travel cause the visa will be granted to him.

Thanks for the helpful response. He will have to adjust to be a Green Card Holder. You are right, it may take some time to bring his wife and children to the States.

If it was a F4 petition (sibling filing for sibling) then your friend can bring his wife and kids with him, he just has to follow the necessary steps to have them become derivatives of said petition.

Did he do his interview already?

The F4 category allows derivative beneficiaries. How old are the children? (I think you said under 4 but I might be misunderstanding?) Has he already received his visa? Derivative beneficiaries (spouse and children under 21) can only be added before the visa is received.

he would have to petition them later because he cannot take it with them.... if he was married by the time he was patitioned he would be able to come with them but since he was not he cant..

It's imperative and in your friends best interest that you answer the questions asked and keep your post updated. You have gotten poor advice by 3 persons so far and it would be really sad if your friend has to be separated from his family unnecessarily for 3-4 years. If you want to be certain what your friend should do: 1) post your friends situation on the F4 thread (link below), 2) contact your DR embassy/consulate (email is best) or 3) simply do Google search of the problem.

This is incorrect.

This is an F4 family preference case - US citizen sister petitions for her brother. It is irrelevant if he was single at the time of the petition. The US government is well aware that siblings will live their lives while waiting to immigrate. The US government understands that they will marry and have children. The US government allows these spouses and children to be added to the petitions in F4 family preference cases.

The petitioner and beneficiary are responsible for updating the case when changes such as marriage, births, and deaths occur.

The petitioner or beneficiary should inform the US Embassy or NVC (whichever currently has the case) that the beneficiary's spouse and children should be added to the case. Be prepared to provide photocopies of the marriage certificate and birth certificates for the spouse and children.

Mr. Tee, your friend can bring his wife and children to the interview and he can bring them here with them. My cousin in law came this way, his wife's mother had petitioned for her a long time ago while she was still a minor, as she grew older, she married and had a child with her husband (my fiance's cousin). At the time of the interview, she brough her husband and child and the proper forms, also informed the NVC, and his visa was granted as well.
