I filed the I130 a few months back for my wife.

She has a few weeks break coming up soon at her job so she wanted to apply for a B2 visa to come to USA.

I told her the chances are slim on getting through but she wants to try so I figure nothing wrong with giving it a shot. Anyways she needs an invitation letter so I wanted to know when i write it do i specifically mention she is my wife? Is it required? Also at POE how does that work? you have to volunteer this info or only answer when asked? We defintely don't want to do anything illegal or that will hurt our CR1 application since that is extremely important.

thanks for your valuable input.

They will know at the POE she has pending CR-1 by the computer records, and even if granted the tourist visa she could be denied entry.

I thought about this and that is what is scary. Because if she comes all the way here only to be turned around at POE it will be devastating to say the least

It seems it might be better not to send an invitation letter at all. She has a job that is under contract with financial sector. I dont know if that alone will show strong ties.

It's not true that she will be denied entry, I've heard of persons right here getting through. Honestly it has to do with the POE official she sees and she has to prove she is returning and not staying to adjust.

Nothing beats a try.

even so she still needs to tell the truth about the pending cr1

Just keep in mind the possibility of being sent home on the next flight if the deny entry. Not saying they will, but it i a definite poscsibility

If she gets a tourist visa, the chance at POE is extremely high. The thing you need to be concerned about is getting the visa in the first place.

Over 50% of tourist visa applications from Guyana were denied last year. http://www.travel.state.gov/pdf/FY11.pdf

Even if you dont put it in the invitation letter, the same question is there on DS-160.

If you have any immediate relative in US and what is the relation, on there she will have to disclose that she has a USC spouse.

So even if you don't mention in the invitation letter she will have that information in her application.

You don't want to lie on the application as it can hurt your i-130.

thanks alot harsh_77

she went to someone who fills out the DS160 for a nominal fee plus you have to buy the appointment date(suprised me i thought it was free).

the person told her that she doesn't need an invitation letter but advised her that the last 3 individuals that applied that were in similiar situation got denied.

so we will focus on gettin the visa first.

thanks for the feedback guys/girls.
