Is anyone still out there? You were all right.. I wanted to believe so much that someone couldn't do this to my heart. Two days after she got her card she was gone.. I feel like such a fool for not listening but I wanted to believe that love couln't be that way.. I feel like such a failure.. Does anyone want to talk to me? I am more lost now than ever...

I'm sorry, but it smells like you not withdraw the I-864, affadavit of support. So she has a green card now.

Yes I did react from the heart. Now I'm paying the price. Not only am I heart broken but now I have a much more difficult legal battle ahead. I've always had such a trust in people & now that is shaken. An attorney told me divorce would only help her as she could take divorce papers in & apply on her own. They suggested I do nothing & at her two year interview she will have no proof of marriage and will have her residency revoked. But I don't like having to wait two years. As painful as this is I want to move on with my life...

she hurt you and you helped her to hurt you more and in the end she has attainted legal status and you are hurting. whats really wrong here? sorry you are going through all these hurtful stuffs but you have alot of blame here. accept it and move on. good luck.

The attorney was wrong.

You are better off filing for divorce now, writing a letter to ICE and USCIS letting them know the details of your relationship breakdown. Then once the divorce is final I would mail them a copy of your divorce decree with her A number and all of her info attached. Once the divorce is final she MUST file for her 10 year card. She is technically in breach of the conditions of her card by not filing right away. She won't be denied for waiting till later, and they're not going to hunt her down, but it would be pretty had to show proof of relationship for a relationship that was fake (on her end) and where divorce was filed so long ago (especially if you've also written to USCIS telling them that she left you long long ago and that you suspect fraud). Also if she encounters ICE at some stage it will be on her record.

She won't have her GC revoked because you refuse to file for divorce. She could try and claim that you're using it against her and try and claim abuse. You're better of filing now and getting it over with. PLUS waiting and remaining married keeps her tied to you. If you passed away while still married, she has a claim to your estate, even if your Will says otherwise. Longer you remain married the more she could be entitled to when you do eventually divorce.

File, move on.

Oh trust me I take full responsibility for my actions. Even though I'm hurting I know I neglected all of the wonderful advise I received here. Obviously if I started this thread there was doubt in my mind. Yet I still trusted her words & ignored her actions. Even now I don't want to hurt her but I need to protect myself & my family first above all. So I don't mind if you all read this & think what a fool or idiot because I'm right there with you..

Thank you V & T, I will try & speak to another immigration attorney. I was troubled by waiting two years. I need to check state laws to see if I can still file for an annulment since fraud was involved. I hope you all know I DO appreciate all your help. I know you were there for me before & I neglected to head your warnings.. Who can truly explain love.. I love her.. I married her.. I planned my life to be with her.. I was the fool.. Again, I can't say enough, thank you all..
