TN Status with I-130 Pending??

Other user does not have the wait time for visa, she is married to USC.

You are trying to immigrate based on your mother, that is different like you have 8-10 years wait she does not have wait.

You can try to get TN and let us know what happens, personally I think it's difficult to get TN when you have pending intent to immigrate.

Not with a wait time of 8-10 years. Remember the relevant time frame is the duration of the first TN visa, which is a year. The pending I-130 won't allow OP to immigrate within that year or even close to it, so it's irrelevant. Perhaps future renewals may get tougher once the priority date comes closer.

you never know ppl even have hard time getting B1/2 who are in family sponsored visa (non spousal) but you never know until you apply.

So I would say go ahead and apply but at same time be prepared to be denied.

To answer your question though, yes you absolutely still qualify for a TN visa and it will not affect your I-130. TN visa is a nonimmigrant visa, however, which means you're not permitted to live permanently in the U.S. As a result, you may face questioning when you apply for the TN regarding your intent to return to Canada at the end of your TN stay. This is especially true of someone with an immigrant petition pending. It's helpful if you can demonstrate that you're retaining a Canadian domicile while in the U.S. and still have links to Canada. If approved, you'll get an initial three years and then can reapply after that.

If you're still in the U.S. when your family visa becomes available, you can adjust your status to permanent resident, or you can return to Canada and apply for the visa at the consulate.

hi, i have a similar case where my i130 was filed by my father in 2001, back then i was still a student in canada. now im working in the US on a TN since 2009, and i just had it renewed may 2012. my question is, i just received a notice for immigration interview scheduled in Oct this year in montreal, and im wondering if my current TN will have any negative impact on the outcome of the interview.
