Hello can somebody advise me please???? I'm married and living with my husband who is a citizen and want to apply a green card for me. We have all the documents that showed that we are married but I'm not on the lease of our apartment because we have not been living together until we got married and it is too late to add me to it. we have to wait until april of next year to renew it and my work authorization will be expired before then and we want to start the process next month. Now we both are worried about that. We have every other documents requested, so do anyone think it is a big issue to worry about? Thanks

At the very least you can ask the landlord or leasing office to write a letter stating that you live there and explaining why they cannot add you to the lease (leasing company policy, etc..) also include copies of license or state ID showing same address can help show that you live together. Joint bank statements showing rent payments also a good idea. Name not on lease shouldn't be a deal breaker. Good luck!!

It is actually law in most states that all people living in a rental must be on the lease, whether they are a co-applicant or not. There is no reason they can't add you on now, it's just a matter of amending the paperwork, and it won't cost you anything.

It is actually law in most states that all people living in a rental must be on the lease, whether they are a co-applicant or not. There is no reason they can't add you on now, it's just a matter of amending the paperwork, and it won't cost you anything.

This isn't true. A lot of states have a law saying that a tenant can share an apartment with adult relatives or a roommate without adding them to the lease. One example is New York.

I think a standard lease (at least the one I'm familiar with, which is federal) states that you can't move someone in without notifying the landlord. From there, it depends on the landlord. Some would have you sign a new lease and raise the rent.

In any case, having both names on lease is nice, but not a requirement. I've seen several people here who were in the same situation, and they just explained it and provided plenty of other evidence.
