Hi everybody. I posted this in the Sept filers thread but figure i might get more replies here. I've been a longtime peruser of these forums. Filed ROC for my wife in sept 2011. Just got an RFE last week. It says we don't have enough to show good faith marriage, etc. When I filed the ROC, I had 2009, 2010 joint tax transcripts, a year's worth of statement from joint business account (we are both owners of a salon and work together everyday) Joint car Title, an invoice for a gold buillion investment along with a copy of the payment check (from joint account). Also we had just opened another joint personal bank account at another bank but only had 3 statements. The RFE letter said this account showed inconsistent activity. Also we had documents showing a joint safety deposit box. And we had car insurance documents showing both on the account. We also had drivers license of both spouses showing same address. We did not summit pictures or affadavits.

The thing is, we don't have any lease, mortgage, utility bills, etc because we live with my parents. I have lived with my parents for the last 10 years, and when my wife came over she has been living there to now. Is living with mom and dad and having no bills associated with owning a home or lease going to be a big problem?

Anyway, I've started gathering stuff to reply to the RFE. So far I used one of those internet law sites to draft 2 medical power of attorneys with living wills for each person (husband +wife), with each naming the spouse as the one to make decisions in case of incapacitation. As well, I've called my insurance company to open 2 term life insurance policies for each person and each policy naming the other one as benefactor. As well I've got ongoing statements from out joint business account. The other bank account we hardly ever use so i probably wont even summit them. I am also getting my parents to do an affadavit saying we live with them, as well as a neighbor saying we live at the address. Also we opened an Edward Jones account in Jan and will summit those statements. But i'm kind of freaking out over not having bills or leases or mortgages. Any suggestions?

Just gather as much as you can. They use a very outdated guideline that simply does not fit current time and especially economy hardtime, even though the stuff you submitted are more than good enough.

Or it could just be another excuse to delay the process.

Thanks for the reply. Also on our RFE it says dont summit already summited evidence. Those that have responded to rfe's you leave out the old evidence?

Also is there a limit to how big this RFE Response package should be? Cause right now, with all the insurance docs and state tax returns (yeah, the rfe said state tax returns, wierd huh?)and pictures, and this and that I'm looking at over 50 pages of documents and I'm still not sure how many photos I should summit. I got hundreds. And one more question (sorry I got so many questions), for the affadavits, do most people use the format given in the example forms on this site? It seems kind of formal and robotic? Or can you use a more simpler format but still include all relevant information?

You should have asked your parents to write an affidavit to explain your living condition, that you two live with your parents so there is no bill nor lease. You can send some more affidavits from friends, pics (I think around 20 is enough), emails, receipts that you bought stuffs for each other that shows your address, W-2 with married status, Emergency Contact List at work shows ur spouse's name, any other insurance, title or 401k with both names.

Sworn affidavits are letters from the people know you and/or your spouse and your marriage. They will be notarized. Your parents's letter is a kind of affidavit. There are some examples of affidavits on this website, under example forms on the top (Gallery, Downloads, Example forms). You can google more about it.

Affidavits are a pain.Me and the person who wrote an affidavit had to go to the notary and pay like $10-15 to get it notarized and then the person who wrote an affidavit had to attach a copy of their US bith certificate or GC. Oh I didn't know that they have to attach those things. How about driver's license? I thought they just need to write all their infos in the letter, phones, ssn, address, work title etc...

I have already ordered a 2011 tax transcript and will be summitting that too. The RFE also listed state returns as good evidence. So I will send copies of the last 3 years state returns.

So opening term life insurance policies for both of us, and having medical power of attorneys and living wills are useless since they are in reaction to RFE? Man all this is such a headache. Its funny they tell you they want to see this and that, and if you go and do it, it's still not good enough cause its in reaction to RFE.

They say a picture is worth a thousand words. And in this case, pictures really do speak worlds of your realationship. It sounds like you are doing the right things. Just take tons of pictures. Friends and family included with you and your spouse. Having a lot of business things together could make it exactly that, a business partnership. Pictures that show love will help!
