I got married to a woman (over-21) whose mother had filed for her AOS (I-130, approved) and her file is with the NVC (multi-year wait for a visa).

She came to visit the USA, we met, fell in love, and got married. So, I am planning to do the concurrent filing (I-130, I-485, etc). However , I have a couple of questions:

I-130: Q16: "Has your relative ever been under immigration proceedings?"

The answer should be yes or no? I can list her previous A-number if needed. Help needed.

I-485: Part 1: A-Number (if any)?"

She does have the A-number from her other case (AOS through her mother). Since I am filing a separate I-130 (along with the I-485), should that A-number be mentioned here? Or do we keep things separate, since this is a separate case?

"immigration proceedings" refers to deportation-related matters, so unless something is missing from the story you should answer "no" to that question. And give her existing A-number.

Hey, My father filed a petition for me and it was approved but I don't think I have an A- number with an i-130 petition. If the petitioner is a naturalized citizen then they would have an A number. My i130 petition receipt through my hubby doesn't have an a number maybe because he's a usc by birth? So I think unless u file I 485 or other forms you would have one but not i-130 (I think).....

Also filing I-130 is not the same as AOS. I-130 is the petition. I-485 is the actual greencard application. In that case she definately wouldn't have an A-number

Hope I explain this well because I was in the same situation so I would just go ahead and put "none" where they ask for a number and they will assign one once they accept you application..

Think of the A number like an SSN. It's her identification number as far as USCIS is concerned so it will stick with her throughout this process and she should not have 2. So you need to list her assigned A number from her other petition on anything you file for her. If she ends up with 2 A numbers that will complicate things and need to be corrected later.

The A number should not be confused with a Naturalization number which she would receive if she eventually decided to apply and was approved for citizenship.

I was doing some research on this A- number thing because I didn't even think about it when I was doing my AOS packet. An a number is assigned to an alien if they previously applied for permanent residency or in case of a student on opt or applying for work permit. With that being said, your wife would not have one by just having an approved petition. I didn't care too much about mine through my dad because I know once my husband file one on my behalf then any previous/approved ones I had would be cancelled automatically...Look over my timetime. I sent in my packet and haven't received any RFEs thus far
