Hello All,

From all that I have read and researched, for the K-1 visa, current income is used to prove the affidavit of support. Send in current pay stubs and a letter from the employer. Well then why are applicants that meet the minimum income level, being told that they need a co-sponsor, because their last year's tax return is below income level, or because they barely meet the income level? Current income is exactly that: CURRENT. Secondly, an income level has to be set somewhere, so if you meet it, then the level is met. Am I missing something?? Maybe for some of you, getting a co-sponsor does not seem like a big deal. I have waited to file the K-1 visa application for almost 2 years; specifically so that I could graduate college, get accepted to graduate school, and get a good job which its pay would at least meet the minimum income level, so that I could support my fiance/husband independently, (I also have 2 children). I find it a huge burden to have to ask friends or family members to be a co-sponsor. I have consulted with attorneys in my area and have been told the same information that I have came across on my own: that k-1 visa affidavit of support is proven by current income, and that past tax returns can be used to prove income levels, but are not judged on them, but more to show that one is a law abiding, tax paying citizen (not that those who don't pay taxes aren't law abiding). It seems as if the Kingston Embassy is looking at both. I guess my point being is: does anyone else have any more information on this? Am I wrong? If you were told to get a co-sponsor and you met current income levels please write to your Congress. Let them know what is going on, regardless if it changes anything or not.... I did not mean to offend anyone, I am done with my rant :)

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

Unfortunately most, if not all, US embassys comply with the 125%. Even for the I-134.

Which is fine, I am above 125%. It's the 2011 tax return for the I-134.
