I need proof my wife is her legally

Hi my wifes insurance provider wants proof shes here legally and her k1 visa expires july 7, they are giving me no latitude here..... Heres a list of acceptable documents

The K1 expired the moment it was used to enter the United States. Her I-94 expires, and after that, she is out of status until AOS is filed for.

The K-1 visa expired the day she used it.

Are you talking about the I-94 expiration? - a valid I-94 can be used.

Have you applied for adjustment of status?

One of the choices is "Form I-129F, K-1 visa." Surely you have that? It's the last box.

I sent a copy, they want an approved i-129f, which the government doesnt send, they send form i797 notice of action........and yes im referring to the expired i94 ......

Its the pcip insurance for california.......when i send the aos i can get an employment auth card right ? If so how long does that take? How do i get it? Sorry im scrambling here

Generally 2-3 months after filing.

You have to apply for the employment auth card. You don't just get it because you applied for AOS - they are two separate forms. See the step by step guides for AOS in the guide section.

You wont get anything " quickly " though it will be 3 months or so for the EAD.

Its possible she will be SOL for a few months as you wont be able to get any proof right this moment of her legal status, if they don't accept the I-94 or the NOA1 from AOS.

Does she have her SSN? If so, give them that and I bet they will think she is a USC or LPR even though she is neither right now. It is amazing what a SSN will do for you. If she does not have the SSN, and her I-94 is expired, like it sounds, then you may have to wait until she gets the GC or EAD if you applied for that. I would make a copy of her K-1 visa in her passport, the I-94, and the NOA1 for the AOS and get a supervisor or higher to explain that she is in the country legally, her conditional status has expired (with the I-94) and you have applied for the GC and it a decision should be made within 6 months and see what they say. Otherwise expect to wait for the GC.

It depends on how dumb the person at the insurance company is. They will require the SSN for a USC or LPR so maybe they think only a person with a SSN is a USC or LPR. It is worth a try. All I had to do for my wife was rattle off her SSN and she was on my insurance and she was not a LPR yet. Hadn't even filed for AOS. Of course this company may now know that she is not a LPR or USC and will require more than just the SSN, but my point was that IF you have a SSN some people take that without the actual proof required because they do not understand who is eligable for a SSN.

But you are right in that now she will most likely need to prove LPR status.

Show them you documents, speak to a supervisor. You cannot have a I94 with out legal entry, show them all your forms. Escalate to a higher power if needed.
