I'm very worried about something. There is a very large possibility I will have to leave the country before my husband does. I'm afraid he will be denied entry at POE because of this. What should I do?

Are you leaving his country to come back to the US before he enters on the K-1? Or are you leaving the US before he enters on the K-1?

I don't think you have anything to worry about, but it does bring up an interesting question. I don't know your case details, but I'm assuming that you are the USC. The rule is that you have to enter the US either before or at the same time as your emigrating spouse, so you entering the US before your spouse shouldn't cause any problems that I can imagine. The interesting question to me is how do they verify whether or not the USC petitioner has entered the country. Maybe they have it on a computer database so they can just pop in there and look. Let them worry about that though, you're following the rules so there's nothing to worry about.

We live in Russia together, but I have some medical issues that are forcing me to move out sooner than we planned, so I'd get there before them. He has a CR1 visa.

It doesn't matter if you are leaving Russia. Where will you be? Will you be in the US when your spouse enter????

As long as you are in the US or you enter with him, then he is okay. If you are outside the US, then he will be denied entry. He cannot enter the US if you are not in the US. This is an absolute requirement based on the I-864.

I'll be in the US, but in a US territory, and his POE will not be in said US territory.

Why are you being so vague????? Just say Puerto Rico, US Virgin Islands, etc. Is it a secret? In the US but in a US territory is pretty vague.

At long as you are in the US, then he will have no problem entering.

Many people I've encountered believe that Puerto Rico is either a state or a foreign country, so I've given up and just call it "a territory" to make matters clear.

So different POE's don't matter at all?

It does not matter at all. He can arrive at any POE. Different POEs is not an issue.

Some people think New Mexico is part of Mexico. Doh!!!!!!
