My boyfriend came from the US to visit me for 2 weeks in the UK. I went back with him on April 11th to the US on the visa waiver to return back to the UK on June 11 (I dont work due to illness). My boyfriend proposed to me on June 15th and we got married on 23rd June at the courthouse. My husband has asked me to stay and not return back to the UK, but i'm worried about being banned from the country. Can anyone give advice? I've read about adjusting status but the only proof I have that I wasn't going to stay is my return ticket, bank account still open and my degree courses starting in September that i had signed up for. I dont have a job due to illness and lived with parents. Also, would the fact that i went to the US with my husband cause problems?

If you had no plans to immigrate when you came over to visit then you should have no plans adjusting your status.

You should have proof of co-mingling your lives, get what you can-do joint bills, name on his insurance/ life insurance-- anything you can get!

If you go back now that would be fine too and your husband could file for CR-1 visa ( spousal visa) which takes around 7-10 months be approved.

Your first issue is who is going to cover the affidavit of support. You can try to file AOS , but if questioned and denied there is no appeal and you then have to start the out of country process. Or go home and start the out of country process.

This will not be over quickly. You will not enjoy this.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
