Question on what employee should write?

Hello All,

I'm starting the process in removing conditional status and wonder what my employer's HR should write to show support? :blink:

Basically, your employer letter should state "To whom it may concern: (first name,last name) has been employed full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company letterhead.

Perhaps nothing.

There's no need to show a certain level of income for removal of conditions. The affidavit of support is well behind you. Forget about that part.

Removal of conditions is all about demonstrating that the marriage is bona fide and not for the purpose of evading immigration law. Evidence of shared finances, a shared residence, and shared social life can be used.

An employer might be able to provide evidence of life insurance policies naming each other as beneficiaries, or shared medical insurance. Maybe someone might be able to provide an affidavit saying they know the two of you and you appear to be a bona fide married couple.

But a letter saying how long you've been employed and at what salary, by itself, probably doesn't help show that the marriage was bona fide and not entered for the purpose of evading immigration law.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

Interesting question. I imagine that your employer does have an interest in having you succeed in your application to remove conditions, but what knowledge of your spousal relationship does your employer's HR department have on which to base a letter written as evidence that you did not marry your wife to evade US immigration law?

I suspect that the best things to get from your company's HR department would be documentation that your wife participates in your benefits - you've got her on the health insurance plan with you, she's the person to be called in case of emergency, she's the beneficiary of your life insurance and 401k plans (if any), things like that.
